replacement eris for silent phone issue

i am going to try taking my eris in to get it exchanged because of the silent phone problem. i am on leak 3. i have some questions first though...

will i even be able to have a legitimate complaint if im on a leaked version?
will a new eris come with 2.1 or 1.5?
if the new eris has 2.1 what are the chances of this happening again?

i cant stand having to reboot to use my phone as a phone.
 
Legit complaint? No, you choose to install a leaked OS instead of the one verizon has, that voids the warranty and any claim you may make against them. Can it be done? Sure, as long as they dont check too deeply into it.
2.1 or 1.5? I would assume 1.5 since I doubt they have upgraded the phones they currently have in stock.
Can it happen again on 2.1? Im sure it can, I believe I have seen people complaining of this in the OTA

1. If you're on "leak v3," they won't know you're on a leak; it looks to them like you got the OTA. Just don't say "it's been doing this for a month" or anything.

2. The new Eris will most likely come with 1.5, and it will eventually prompt you to install 2.1 OTA (or you can do it manually).

3. When the new Eris has 2.1, it might happen again if your replacement phone is another of the "unlucky" phones. No one has identified the difference between phones that do and don't get the bug.

Be sure to do a factory reset *before* you bring it in to the store, because otherwise they're going to suggest that. And if you can bring it in silent, that would be excellent, but I doubt you'll be able to trigger the bug on demand.

I don't want to start a big argument, but in my opinion it IS a legitimate complaint because the "leaked OS" we installed was in fact the official, final OS signed by Verizon and HTC. If you brought it in with an older leak, sure, that's a problem. But once you upgraded to "leak v3," you reinstated your warranty.

i know its not "legit" per say... but since its pretty much known now that the issue does not stem from the software (ota or leak) but rather a hardware issue. so with that being said, if verizon knows this then the OS version should be irrelevant. at least thats how i see it.

Yes you have a legit complaint because v3 is the same as the ota. People on the OTA are complaining about the silent issue as well. It is possible it can happen again, I think it is hardware related that 2.1 brings out in the open. I've never had it happen on any of the leaked versions but others have. I'll let you know what the replacement comes with, I have one coming in today. My trackball got screwed up somehow and now is always going to the left or right. Makes the phone almost unusable lol. Once I get my replacement phone in tho I'll let ya know which it comes loaded with.

No, the leaked version was not in fact the official version, there are differences, not the least of which is the hboot version. If it was the official version, as released from verizon, then every thing would be exactly the same in both. But they are not. Therefore, the leak is not the official OTA that was released, hence still voiding the warranty

The leaked versions are signed versions from VZW. They are legit versions of the OS. One of the leaks was leaked by a VZW employee. No VZW employee would check the hboot version. The hboot version doesn't matter when operating the phone, either. The OTA and v3 leak are the same. The checksums prove it beyond any argument anybody can make. It's the very reason that people with the leak are not getting the OTA update. As far as VZW is concerned, the people with the v3 leak already have the OTA.

It's a legit issue and if taken to VZW will be considered one, because they won't be able to distinguish between a phone with the OTA and one with the leak v3.

I have leak v3 and sent an email to Verizon stating I have the new 2.1 software and I am having the silent call issue. I wanted to see what they said. To my surprise they said no we don't show your phone has received the official 2.1 update yet?? Great! I don't know if they will give me trouble if I pursue the issue.

I have a replacement coming tomorrow for the silent call problem. They asked no questions when I said I was on 2.1 (and I'm on leak v3), and said they'd go ahead and get me a replacement sent out asap. I was very happy with the service. I just hope I don't get another problem phone, as this is my second replacement (first one due to overheated battery that almost caught my pants on fire!).

Call again and talk to a different rep. If they say, "we don't show your phone has received the official 2.1 update yet," tell them their system is wrong.

Regardless of whether you're on a leak or not, the silent call issue is still happening on the OTA. My wife would not let me install any of the leaks for fear of receiving the silent call issue....but now that she has received the OTA, guess what??? She got the silent call bug!

I took mine in and got a replacement, but I think it has a blown speaker. When I call *228 the ear piece crackles horribly.
