Hello mexilhao welcome to Android Forums.

Can`t believe this , T-Mobile fraudulently reported my phones IMEI # lost to a black list now they say they can`t fix it that i have to take the loss of $700 phone ,that is very wrong, time to take a different approach maybe a lawyer would be good thing.

Sounds like what's happened to your phone, consulting with a lawyer might be all you can do. Given that it's unlawful to change or tamper with a phone's IMEI. What actually happened, did you have a dispute with T-Mobile over a contract? - and ended up not paying it?

No , i got my s4 from att unlocked paid $694 at AT&T store. went to metro used it for 15 days then i got a mm#6 error went to metro they told me T-mobile reported this phone lost and they blacklisted my IMEI by mistake nothing they can do. AT&T not their fault so no returns.

Have you tried to see if T-Mobile/MetroPCS would be willing to give you one of their GS4 models to replace yours if it was truly their mistake?

Was it a real AT&T store? Or was it a reseller with a big AT&T sign in the window. Hard to tell sometimes.

Also, I can conspiracy theory this up for you.....an AT&T sales rep has friends with stolen phones. He brings one in and sells it to you as the brand new AT&T unlocked S4 and keeps the one that was supposed to be in the box to himself. Eventually, time caught up to the phone you walked out with and it was blacklisted. Does the ESN on the phone match the ESN on the box? On the receipt?

Here is what they told me, wen i asked them for a replacement or remove the Imei # from the list.
I got the phone on 8/16/2013 use it at metro no problem there until 8/31/2013 wen T-MOBILE blocked it. so this is where i`m at now with a $700 paper weight.
We are not able to complete this request, only the original person who reported the phone lost/stolen is able to lift the block. As AT&T sold you a phone that was on the block list, the only way to resolve this is to return the phone.

do you think they would though because it's an ATT one not a T-mo branded one?

Can you possibly post a picture of the receipt with your personal information blacked out. It would be helpful to see what it says, the address of the store and what not. We have a staff member who works for AT&T Customer Care that would probably like to see this information.

Don`t think they would be able to replace my phone it a 32gb all they have are 16gb + for what they have told me so far , is like get your self a new phone leave us alone, thats what i`m getting from them.

Idk, it's worth a shot because if they're legitimately at fault, it potentially saves time if OP takes them to small claims court over the value of the phone.

There must be a way . FCC ,better business bureau or something like that, district attorney ?

I agree, I think you can do small claims, but how much would it cost for the lawyer etc? like would it really be worth it?

There's no lawyers in small claims, it's only litigant vs litigant.

see, learn something new every day, didn't know that, my concern about the whole thing is that the IMEI just magically became blacklisted, I mean quite literally, what would cause something like that? if someone made a mistake when doing it, wouldn't they have fixed it when they screwed up?

Only one of 2 cases come to mind. Either T-Mobile blacklisted the wrong phone by typing in his IMEI when trying to blacklist another phone, or AT&T sold him a used phone as new where the original owner reported it lost/stolen after the sale took place.

so in either case, he would need some sort of reputable evidence stating all the things are right and proper

Perfect, now can you confirm that the IMEI programmed into the phone by going to setting->about phone->status matches the IMEI on the box?

Alright, so with that being the case I see one of two possibilities. Either T-Mobile mistakenly blacklisted your phone which I believe would make them liable for it, or someone else fraudulently claimed your device stolen. You could try to see if AT&T will exchange your device given the situation or if Samsung will allow you to exchange under warranty since you have the recipt, but I wouldn't bet to heavily on that. If not, then it's up to you if you feel it's worth trying to reclaim the value of the phone in small claims court.

What you really need to do is find out who put the claim of your device being lost. I'm not sure if this is something that can be easily given out, or if it will take a court order. But who ever made this claim is the one you'd end up suing for the $696 value of the phone.

Obviously if you can get AT&T or Samsung to replace it, that would be the ideal and least painful method.

T-MOBILE responsible all the way , they the ones who submitted it to black list.
Anyway thank you for your help and info.
Going back to metro tomorrow see if they can do anything.

Went to metro this morning, they told me their working on removing it from the list to go back later on this afternoon 4 o`clock i guess . I`ll keep posting with the outcome .

I hate to give you such a horrible advice but contact your CC. I had a payment to a scumbag lawyer once who charged me $2000 for service that was not completely delivered. CC company gave me all my money back in a day. Even though I called that lawyer before CC claim and offered him to settle for $500, he just refused. Oh well. I hope you were smart enough to pay with your credit card.
It sounds like you were a victim of a sophisticated scam.
