Apps that go against Google Play terms & conditions get submitted. How?

Hey developers

Here is the question: How do applications that go against the Google Play rules are actually submitted there? Why Google does not approve one app but approves another one with the same features? Any ideas why this happens? How to get submitted?
 
Do you have an example of an app that has broken a rule, and which rule it broke?

Also, fom their website: Publishing Overview | Android Developers

"If you are satisfied that your publishing settings are correctly configured and your uploaded application is ready to be released to the public, you can simply click Publish in the developer console and within minutes your application will be live and available for download around the world."

I'm not 100% sure but it looks like an app might only get taken down if it gets reported for actually breaking a rule, Google can't check all of the apps before they go up.
