at&t data pay per use plan?

will this plan work with s3, should i be able to reciev and send mms. att's telling me the phone cant do it is this true.
 
possible ive seen other carriers make you get at least a basic data plan to use MMS on a smartphone, just another scam for them to get people paying for data plans

correct like my post above says, some carriers need a data plan even if its 50MB a month in order for mms to work
