Help AT&T screws themselves

Just off the livechat with at&t rep....they have good deal on new galaxy3 for 149.00 with 2 year contract, jumping my monthly fee by $20.00 for the newer device...but were wanting a $40.00 upgrade fee(basically a money grab as all I had to do was switch sim). As I've been with them since 1985, currently have data on my plan, and am in a month to month basis (contract ran out a few years ago) figured they'd be glad to lock me in for another 2 year contract by waiving the upgrade fee.....2 hrs of chat and they still wouldn't waive it and I wouldn't change to their Next plan(pay them monthly now for an upgrade in the future).....Am wondering if anyone knows of any problems with just switching sim into an unlocked or at&t note 3 bought off ebay thereby not paying their upgrade fee and not paying the extra 20 a month(which I would have been happy to pay)....Anybody know of any problems with this line of thought?
 
as long as the device you buy is either an AT&T phone or its a device that is unlocked and can work with AT&T frequency, it should work just fine with your SIM. The other thing to keep in mind is that size of the sim you currently have and what size the new phone requires.
