AT&T trying to force me on a smartphone data plan!

So I bought the Nexus S a few weeks ago and before purchase I was told by AT&T that because the phone didnt support their 3G i wouldnt have to have a smartphone on my plan and I could pay the 10 dollar unlimited EDGE data plan. So for these weeks that passed that was the plan that I had and all was well. this morning I awake to a text from AT&T that states that they have added the smartphone data plan to my phone. So I call in and ask what the heck is going on. They proceed to explain that my phone shows up in their system as a smartphone and I have to have the 25 dollar data plan! So I argue for a half an hour, the outcome....
they are calling me in 48 hours with one of the two options I told them was the only acceptable solutions. 1. Keep the 10 EDGE plan on or 2. Waive my ETF so i can port my number to tmobile. The manager said that after i argued with him for an additional half an hour. So now I wait and see which one I get. What do you guys think?
 
Well.. in all fairness.. it is in their "TOS" that you will pay 15$ or 25$ on any smartphone you bring to their network.

With most phone's. Unlocked tmobile devices, or unlocked nokia's, people get away with the unlimited medianet plans.. however, with the nexus device's.. At&t seems bent on catching them..

Also.. just because it is in their TOS doesn't really make it right..

Why should you have to pay subsidized priced bills on something you didn't get a discount on?

I hope they let you get one of the two options you suggested. Either one really..

thanks me too. I dont mind staying so the 10 option is great for me but if I have to i will leave. I hope it works out
 
While their TOS may state smartphones require X data plan, if a representative of their company gave you the ok they should honor it. Good luck either way

yes exactly what i said they not only said so I had the 10 dollar plan for over a week and then all of a sudden its you cant use that. WTF?
 
Actually I have heard a lot about that..

WIth the n1 a lot of their reps didn't even know what it was.. the others just stuck em on the Data plan and it created some problems.

Sadly it becomes "he said, she said"

The only difference is i have the proof that the 10 data package was on my account
 
I guess that answers the question whether the phone will get flagged on AT&T.

As to the data charges, I think you're fighting a losing battle on the (family messaging?) phone plan. The automated sweep that added the smartphone plan will just keep adding it back if it detects that IMEI. I think they did the same thing to the Nexus One with T-Mobile frequencies (came out first). It only got edge speeds as well.

The rep being wrong is an issue you should pursue.

Should you decide to stay, how much bandwidth can you really go through on edge? There is the cheaper 200MB $15 plan now ($25 is for 2GB).

we will see what happens on thursday i mean if they dont waive the etf and i have to stay im gonna wait a few weeks when something else comes out and maybe have to switch phones. As much as i love the Nexus S if i have to pay for 3G im gonna get something with 3G
