at&t trying to take my data exclusion plan

i had a blackberry curve for many years, with poor service finally i told att i was leaving . in order to keep me they asked what could they do. we agreed on a galaxy s3 for free and no changes to my account or data exclusion plan. they agreed. month later found that they put a plan on my account, i called argued my case and the restored my data exclusion. don't forget i went from a smart phone to a smart phone, and the agreed to keep my account the same. called the other day to find out why i couldn't receive picture mail and was told its because i don't have a data plan, and in order to keep this phone one is required. i showed proof that that wasn't the case and they said that one would be added in the future by att. what i don't understand is i didnt ask for the upgrade they offered me a deal in order to keep me.they said that it wouldn't cost me anymore money a month and i took it. what would you do now. note she did say that she will call me back to see if something could be done to keep my data exclusion. dont say if u upgrade you loose the plan because we both already knew that and the agreed to give me the phone without any changes to my account or need for a data plan. what would you do. i dont use data on my phone it's always turned off i have no need for the INTERNET on the phone. i just like the phone itself sound, ease of use etc.

heres the thing obviously a blackberry and a smart phone are 2 different types of phones. if she agreed to give you a smartphone for free with no charge. you would still need to buy a data plan. since you didn't have one. data plans are required on a smartphone device no matter what if you are not using the internet. if you dont want that then stick with a basic phone or a blackberry..

I don't see your reasoning behind this. Have you noticed how many basic phones verizon carries? and don't say oh well att, tmobile, sprint have options...because they will soon follow big red. I agree its ridiculous that if you pay full price for a phone that you are required to have data...again this is YOUR property. So basically you are saying if you buy a computer you are REQUIRED to buy internet, or if you buy a TV you are REQUIRED to buy cable even if you don't use it.

I do side with att though because they aren't going to give you a free phone that costs $600 off contract and not make you sign a data plan. However if you want to buy a phone out right, then you have only one option I can think of. That would be rooting the phone and when you activate it you would have to make the phone believe it is another phone during manual activation. That way you could activate it through the network and when you sign into your account it would show a non smart phone.

as archaic as it is, blackberry is still a smartphone...it uses data just like the S3.

Bottom line is if you were told you were getting the S3 without having to get a data plan, then that's what they need to stick to...if not, leave like you originally planned
