Help Battery unloads in 1 hour

My half year old HTC Magic has problems with loading the battery (non of the LED is lighting up and also the icon does not show that it load.
But it loads somehow when I plug it in the loader.

It shows after a while that it is 100% loaded.
But it unloads in 90 minutes completely.

Is this a battery issue or a hardware issue?

I also made hard reset, but it did not change a thing.

What to do?
Buy a new battery or send it back to Vodafone?

Just send it back and get them to fix it. There's no point you having to replace the battery if it's under warranty

Yes that is what I did.
A new battery ddi not solve the problem. HTC replied me after the second mail. Last night I found the bill and the box.
Vodafone told me that they are going to test the phone and will call me in a few days.
If it's broken then I need to go back to the Vadafone store to sign a form and take the (original) battery. They will send me then a new phone without battery.
I don't think that the phone will not pass the test because I am no a fool that don't know how to charge a mobile
