Buying from Amazon w/keeping Unlimited data

I am sure this has been discussed in the past.

Background on my phones:
My phone - Galaxy Nexus - unlimited data - still under contact
Wife's phone - Thunderbolt (worst phone ever) -unlimited data ( but she will lose it) - no longer under contract.

Long story short my wife phone is no longer under contract. We both have unlimited data now but her Thunderbolt is crapping out on her so I want to give her my Galaxy Nexus and I want to get a Note 2. I understand that she will lose her unlimited data but she never really used that much. Me on the other hand use 25+ GB a month so I need to keep my Unlimited data. Would either one of these 2 options work?

#1 Option: since the Thunderbolt contract is up. I would upgrade the Thunderbolt with the Note 2 (losing unlimited on that line) then swap the Note 2 to my line and the Galaxy Nexus to her line. Would that work? Doing it this way Amazon has the Note 2 for $199.

#2 Option: Add a new line to the family plan with the Note 2 then cancel the Thunderbolt line (since the contract is up). After that swap the Galaxy Nexus and Note 2 so I would have the Note 2 on the unlimited data line. Would this work? Doing it this way is there any way I could move the previous number (wife's #) over to the new line? Doing it this way Amazon has the Note 2 for $79.

Both ideas would work, but I would read over Amazon's Terms and Conditions. I believe that failure to keep the phone on the updated or new line for a certain amount of time could result in an extra penalty/fee from Amazon, though not Verizon itself. However if you do either of these options by buying the phone in a Verizon store/online/telephone, you would not be subjected to that fee.
 
Thank you for the reply. I looked through the TOS but I could not find anything about swapping phones. I saw that you have to keep the line active with data, which I would. If anyone knows the TOS regarding swapping Amazon phones, please let me know.

ok so i found the TOS of Amazon and it looks like I can not swap. if I do then i have to pay $400. Is this right?


AmazonWireless Terms and Conditions

Instant Discount Policy Additional Terms Instant Discount Policy When you purchase your device with service from AmazonWireless.com, we automatically pass along an instant discount based on a commission paid to AmazonWireless by your wireless service carrier. The commission depends upon your continued service, and if you do not maintain your service for 181 days from the service activation date, AmazonWireless must return the commission to the carrier. Thus, this discount has been provided to you in good faith based on your agreement to (a) activate a new or extend an existing line of service for the device(s) with the carrier for two years, (b) maintain this line of service in good standing, and (c) not alter the line of service type other than adding an additional line of service to an individual account for at least 181 consecutive days.

The following are some scenarios where we may determine that you have not maintained your service and have not met the requirements listed above:

If your device with the carrier is not activated per Amazon's activation instructions within 14 days

If your service is canceled/disconnected before 181 days and you do not return the device(s) to Amazon

If a new individual or new family account is merged with or replaces a pre-existing account


If you transfer this equipment to another carrier's service or to another line in your family account and deactivate the line that Amazon established for your device

By accepting this Instant Discount Policy, you agree to repay $400 per smart phone or tablet and $200 per other device if you do not maintain your carrier service for 181 consecutive days from the service activation date. You also authorize us to collect that amount using any credit card we have on record for you. Amazon can periodically check your account status with the carrier to confirm your line of service is active and in good standing and thereby confirm you are in compliance with this policy.
 
Looks that way, and that's a pretty steep penalty. But if you did this by purchasing at Verizon, you could avoid the penalty.

That is the part you need to read. If the line that you used the upgrade on gets deactivated or changes it's plan you go against the TOS. In the way they word it, it makes you think changing it to a different line would result in fee, but the AND means you have to do both.
