Can any good come of this? (warranty issue)

I bought my phone the day it came out (Feb 2011) at Best Buy, and put it in a case and covered the screen with a Zagg. I've noticed some dust/spots on the screen so I got my free replacement from Zagg, took off the old cover, and its UNDER the screen! I call HTC, they say I have to send it in, they'll diagnose it and make sure I don't have any illegal software, make sure there's no physical damage, and make sure it hasn't been in water and then they will fix it and send it back. Problem 1: 7-10 days without a phone, Problem 2: I've rooted and upgraded the radio and ROMs.

I read online where people get their phones replaced due to dust under screens. I go talk to the ATT store, they say there's nothing they can do. I go to Best Buy and just get their opinion, and they said if I go to to the ATT store, they'll make sure it's not be damaged and probably replace it on the spot.

So I'm stuck here with a distracting spots under the screen, and not really enjoying the answers I'm getting. Anyone have any advice?

Warranty claims can be a b*tch. Personally, I'd flash it back to stock and send it in for repair. If you don't have an old phone laying around, you can pick up a cheap go phone and throw your sim in it for the week.
