Interesting question showed up on yahoo answers from someone who just placed an order for a Cliq (without contract) for $44.99
I'm sure this is an error on Amazon's part, but if you click on the "buy without contract" the pricing stays at $44.99 and he was able to complete checkout for that price (plus shipping)...
I don't know what Amazon's policy is on errors on THEIR end I'm almost tempted to try it myself
