My firmware says I don't have any updates but my brother has the same phone and I can't get the new update for jellybean on my phone. Can someone please help me out.

If you and your brother are on different carriers, that could be it. Or when a carrier rolls out updates, they don't go to everyone all at once; otherwise their server would get overloaded.
So if you're both on the same carrier, be patient. besides, Jelly Bean isn't all that much of an advancement over Ice Cream Sandwich.
