help with my scheme

I have a dummy phone plan with unlimited everything. My fiancee has a smart phone but her contract is running out and she wants a new one.

I am moving my number to google voice, getting a new prepaid dummy phone line, and forwarding the google voice number to the dummy phone.

Will ATT let me take her number and apply it to my dummy plan? Then, I'll buy her a GSM droid and switch out the IMEI to my old dummy phone.

Is this a good plan? Will it work? Is it legal?

Thanks in advance for any help/advice you can offer.

I have four phones on my plan. In the past, when a phone has been up for an upgrade, we have gotten the upgrade and then put a different user's SIM into the new phone without any problem.

Here is an update of the confused explanation I gave and then withdrew.

In one case, an iPhone of user A was due for an upgrade. We ordered a cheap feature phone for user B (exactly what B wanted). When the phone arrived, we removed the SIM card before ever turning it on. We then moved B's SIM card to the new phone. User A continued to use the iPhone on the same number A always had. User B used the new phone, on B's same number as always.

Later, user B's phone was due for upgrade. We ordered an iPhone at the store and had the store person set it up for user A's line. Later AT&T started charging B's line for a data plan because they thought it was an iPhone. A simple call fixed that by indicating that the iPhone was on A's line and had always and still had a data plan. User B did not need, nor even want a data plan and was on a feature phone.

You can use an upgrade to get a phone for a different line like mentioned above but if it's a smartphone then it will require a smart phone data plan the dumbphone data plan will not be valid and att will automatically change the plan to the appropriate one since the starting smartphone plan is $15 for 200mb that is what will automatically be chosen.

And on a side note
