How can you commit homicide against a fetus if it's not a human being?

In the California Penal Code, homicide is defined as "the unlawful killing of a human being".

Here in California, it is possible to commit homicide on a fetus.

Hence, a fetus is a human being under California law... or we just have a serious legal contradiction in our penal code.

That doesn't surprise me though, since the pro-abortion crowd is a big contradiction since they support homicide against fetuses, but not against convicted murderers.

I think you are dealing in too big of an absolute here. In general, I do not think the pro-abortion crowd is for abortions and against the death sentence. Again the issue is lack of definition IMO.
