How Smart are You? Cloning a Phone

The facts (MyTouch G4 Slide :
1. Phone heats up even in freezing weather.
2. Error Message says "SD Card Removed" when it has not.
3. Fast Battery Drains
4. Phone shuts off on own
5. Echos on calls
6. Beeps in background on calls

The really interesting stuff:

7. The system time can not access the network and defaults to random times --every time turned off or shut down.
8. The date resets to January 1, 1970 every time shut down or battery removed.
9. Call log not logging some outgoing and incoming calls.

The really, really interesting stuff

10. In a legal battle and other side super sophisticated with network software security and phone security.
11. Have a back up phone (centro) and having similar issues.

The challenge... someone to explain a rational reason for all this and dispel the notion my phones are cloned. These phones are mini computers. Why can't they be hacked and accessed remotely like any ordinary computer? (FYI: Phone has never been out of my possession.)

Oh...by the way...all items 1-11 non-stop at height of legal issues but as of a few days ago when reason for calming of legal situation...suddenly most issues went away.

Please only responses by those with serious thoughts on the subject... this is a custody battle so stakes are very high. Thank you!
 
Wow, sounds like someone put spy software on your phone. I would wipe it and reinstall the factory software. BTW, don't talk with your phone around (and I don't mean phone calls). They can remotely turn the mic on and hear everything even if the phone is off...
 
thank your wife for putting spy software on your phone.
TMobile doesn't clone phones, you would clone a SIM card if you wanted to hack the system.
