Hello everyone, I need some information. I was up for new every two, in May 09. I currently have the Blackberry Curve 8330 and wanted to wait for the Storm 2 to come out. I upgraded to the Storm 2 on November 2, really didn't care for it much returned it on November 6th and got the Droid Eris. I really liked the Eris, but then started reading some more and think I would be much happier with the Passion. My 30 day window for returning the Eris was approaching so I returned it today and got the Curve reactivated. As I was being taken care of one manager tells me I have to wait 6 months now to upgrade since I made two returns, but the other manger in the store was saying I only have to wait 3 days to avoid the $35 restocking fee. Can anyone provide me with accurate information, and tell me where I can find it. Thank you.. I plan on waiting for the Passion to come out.

If you return the Eris you will technically not be eligible for an upgrade for another 20 months or 12 if your on a primary/single line that is 50 or higher. The restocking fee would still apply until you are eligible to upgrade again. The only way around this is to find someone willing to make an exception. Returning a device because you don't like it though doesn't go very far with most people. The returns were all your choice, generally referred to as buyers remorse in the business world.
