Person Droiding the Balloon Boy Fight?

Well first the Droid was even announced till October 28th and this is October 19th so I highly doubt some random guy got one 11 days before even announced but anyway while hes filiming hes pressing a button in the middle and on the Droid it wouldve clicked the Home or back button...so its probably NOT the droid

I thought it looked like he had his finger on the tab off the screen at the bottom in portrait...and the other on the gold camera button.
