Which Phone and some qurstions

So I am thinking about switching from Virgin Mobile to T-Mobile, but IDK which phone to get.

S4, GN3, or HTC One?

Also do I have to buy the phone outright to be able to use it on T-Mobile's $70 prepaid plan? Also on VM I can tether without a tether plan, is that possible on T-Mobile without getting shut off?
 
To use prepaid, you so need to buy the device outright. The prepaid plans don't have tethering built in though. However, there is a postpaid plan that allows for unthrottled unlimited data, it does permit 500MB of tethering as part of the plan, and will allow you to buy the device on a payment plan instead of all upfront.
 
Just to clarify, T-Mobile's postpaid and prepaid plans are both $70/month for the unlimited plan and neither has a contract. Postpaid allows for tethering and data roaming, prepaid does not (though T-Mobile prepaid does have talk/text roaming).

Prepaid you will need to buy the phone outright, postpaid you can get zero percent financing on a phone, which will add to your monthly bill ($70 for plan + monthly payment for the phone).

As for the best phone, from what I'd seeing I'd wait until the end of the month and buy the Nexus 5, when it is released. It should be around $350 for a high end phone -- about half the price of most high end phones.
 
Well I don't pay for the tethering plan on Virgin Mobile and I can still tether. Can I still do that on TMobile with out getting kicked off?
 
T-Mobile's pretty good at detecting tethering before you can even get started. So if the plan doesn't have tethering built in, you may not even be successful at getting it going. Thus, wouldn't have to worry about getting kicked off. However if you do manage to get around it, they do say that they reserve the right to kick you off for breach of TOS if they feel it's necessary.
