Wireless tethering is now legal per FCC ruling today. Check it out on ZDNet. Since this deals with block C maybe they will make them unlock the bootloader too.

so why does my gf's razr still prompt her to pay two bucks a month in order to turn on her hotspot? will this be fixed with an ota? or does she just have to use an app?

Could be one of 2 reasons.

1) The ruling does not apply to unlimited plans (total BS in my opinion but it is what it is).

OR

2) Since the ruling just happened, Verizon will likely take a certain period of time to update their systems. My guess is an OTA is required (just a guess).

she doesnt have unlimited. and wow, i just heard a vz commercial today, and theyre now marketing the fact that they cant charge for tethering as a feature...

I just read the article on Verizon's new "Share Everything" family plans. They will charge $50 for 1G of data. That's unbelievable. Very expensive data.

And from that article:
Verizon is no longer offering unlimited data plans. Instead, the network giant is now offering Share Everything plans that offer unlimited voice and text, but doesn't offer unlimited data options. These plans do include free tethering, however.

I upgraded from 3G DroidX to 4G SIII last week and I also have a xoom tablet with hotspot so I specifically asked if the SIII now could be used as hotspot and they said yes. I did test it on the SIII and it did allow me to enable and bring up wifi hotspot without the nag screen notive.

And companies are free to offer whatever products/services they choose. The only exception would be companies that are working as government mandated monopolies such as the Bell System once was or as some public utility companies currently operate. And that's not the cell phone service providers.
