The Chicago area has some pretty decent LTE coverage, but there are still some pockets in the 'burbs and downtown Chicago that are not lit up yet.
As far as legal ramifications, anybody who is a Sprint customer and upgraded to a LTE phone should have known or at least the rep should have told them that Sprint is still rolling out Network Vision, and coverage would be pretty spotty for the foreeable future. So I'm not sure if a lawsuit would hold any water. It's probably buried in the contract everyone signs about service performance.
This is a pretty big undertaking for Sprint and won't be complete for quite a while. We're talking hundreds of tower upgrades across the country and it's not like they can snap their fingers and BAM instant LTE.
People should really do their homework before going with a service provider.
