Class Action Suit for 2.0

I am going to go to a T-mobile store with a hidden camera (may use my behold2 haha) sometime this week and act like I am interested in the behold 2 and see if i can get the rep to use the update claim to sell it to me then I am going to act as though I do not believe him and see how far he (or she) will go to make a sell.
 
I also saved that video way back when :-P I figured they would delete it. Also, I don't want technically a "sueing", I would much rather they release the update, give us the galaxy s which will run it, or pay us back. As far as the hidden camera idea, that could be considered entrapment and can be illegal. Make sure you check your local laws.

As far as my state goes its legal from what I have read it is not however admissible in court. But a video of the lie would prove T-mobile is partly at fault for allowing their employees to continue to cover this up.
 
With an email I sent to customer support, I specifically stated that I wanted a response by FRIDAY from someone who makes decisions, or I would be contacting the FTC. I doubt they will get back to me, but if we all get our local papers to write about it, we'd be hitting a home run. If Samsung loses 300 customers, they won't give 2 shits, if the entire country knows, something will happen.

All of us loyal Behold 2 owners have been lied to. When we purchased our phones, most of us were told we would get the Android 2.x when it was available (sometime this spring/summer). Samsung recently released info that there will NOT be any updates beyond 1.6. This was said in multiple emails to many different people. There is no reason T-Mobile should have deleted my original post unless they know about it as well and do not want customers to find out. If any of you are into the Android OS, you probably read on AndroidSpin, and other sites and have noticed news stories about a petition to Samsung. If not:

Please sign the petition if you are angered by this fact. False advertising is against regulations and legal action can be taken. Most of us spent our hard earned money for a pretty good spec phone, and now are basically being told to buzz off. If it comes down to it, most of us will be leaving T-mobile and going elsewhere. We are hoping to get T-Mobile on our side with this. Please watch the video on that link (And yes it is a Samsung rep). Also, please read the petition, and sign it if it applies to you! at:

For everyone out there lucky enough to be able to afford a new phone if you jump ship I don't blame you. With that said, there will still be some of us, like me, who won't be able to do that anytime soon. If you are going to jump ship I ask please help us with signing the petition and spreading the word about what Samsung is trying to do to us. From what I can tell we have been a pretty tight knit community of Behold II users. I may be overstating things but that's how I view it.

Whether or not we have a real legal foot to stand on or if any kind of settlement will come soon enough or have value enough to make a difference. However, what will really matter is the court of public opinion. We know we are starting to get to Samsung. There attempt to get rid of the video that has the promise of 2.0 is evidence of that. The more of us that write emails or even letters to websites like engadget, mobilecrunch, redmondpie, or even cnet the better chance we have that our story will be ran with. Try to make your emails as force full on the subject in the most professional manner possible so they are taken seriously and not dismissed as some ranting pissed off idiot. I'm not point fingers or saying anyone has it's again just my humble opinion. I also feel like if these stories start showing up on well known sites like engadgent or mobilecrunch the more likely samsung may decide that the possible loss of future customers of any of their products will far out way the monetary loss of a law suit settlement. Hell I'm sure if we could at least get the full source code for a 2.x rom would sufice in some way. Then maybe some developers could get us a working rom. Whether that will happen or not I honestly don't know; probably not due to proprietary thigs that would come with that. But if we could get a working stock android source code for the BH2 maybe that would be a win win for samsung. Get the ones willing to install roms, who are likely the ones signing the petition of their back while still forcing some to upgrade to the galaxy s when it comes along. Who knows though? Again this is only my humble opinion.
 
For those people that say "well that video is not from samsung it was a third party retailer so of course samsung going to pull it and claim copyright infringement, they used samsung's logo without permission and now samsung is being blamed", explain to me why they let the following videos stay on the same 3rd parties youtube page also with the samsung logo.......

They Have Removed the Video that we all Saw that Promo the android 2.0 upgrade!
Samsux is trying to Covery there ass now, we Def. hit Nerves with them..

Like I said... there is a language that people in business respond to and understand...media!

Removing the video shows that we got their attention.

Because a Class Action was mentioned, their joining of our forums might also be saying that they want to show that they "have shown an active interest in their customer's needs?"

What seems odd is the DATE that they joined us: YESTERDAY...Consider the dates and the content of all of their previous lack of concern (there is no plan to update the T939 with 2.x) correspondence with their subtle "we couldn't care less" tone juxtaposed to this new appearance of "solidarity of joining the forums" (this could be a strategy?)

Keep all of your emails and keep copies of snail mail. Record all dates of when you call(ed) support or the corporate offices, whom you spoke with, and what was said, an employee ID if they have one and the time of day.
