Class Action Suit for 2.0

I'm with everyone in the same boat, but if you read Michael Gartenberg's editorial this past week, it could shed some light on Samsung's view of the device.

While I agree with Gartenberg to some extent, the point about the ability to upgrade and obsolescence of this device are not applicable. The ability lies within Samsung's ability to make the drivers compatible with the new software.

Absolutely, especially with the RAM and the processor. I was just trying to enlighten people about how Samsung might view the device. It was bugging me how inflammatory some of the comments are.

Don't get me wrong. I'm pissed, but I choose to look at all sides of the equation so I can rebut their opinion with a better idea of where they're coming from.
 
Guys, send a tip to engadget, they might run the story and that will add a little more muscle to our cause.

I signed. This is a tragedy. I was told by T-mobile service guy that this phone would had been able to be updated to android 2x. I bought phone 2 months ago. PLEASE FOR THE SAKE OF EVERYONE PLEASE SIGN UP>>>>>WE NEED PRESSURE ON ALL OF THEM.


For everyone out there lucky enough to be able to afford a new phone if you jump ship I don't blame you. With that said, there will still be some of us, like me, who won't be able to do that anytime soon. If you are going to jump ship I ask please help us with signing the petition and spreading the word about what Samsung is trying to do to us. From what I can tell we have been a pretty tight knit community of Behold II users. I may be overstating things but that's how I view it.

Whether or not we have a real legal foot to stand on or if any kind of settlement will come soon enough or have value enough to make a difference. However, what will really matter is the court of public opinion. We know we are starting to get to Samsung. There attempt to get rid of the video that has the promise of 2.0 is evidence of that. The more of us that write emails or even letters to websites like engadget, mobilecrunch, redmondpie, or even cnet the better chance we have that our story will be ran with. Try to make your emails as force full on the subject in the most professional manner possible so they are taken seriously and not dismissed as some ranting pissed off idiot. I'm not point fingers or saying anyone has it's again just my humble opinion. I also feel like if these stories start showing up on well known sites like engadgent or mobilecrunch the more likely samsung may decide that the possible loss of future customers of any of their products will far out way the monetary loss of a law suit settlement. Hell I'm sure if we could at least get the full source code for a 2.x rom would sufice in some way. Then maybe some developers could get us a working rom. Whether that will happen or not I honestly don't know; probably not due to proprietary thigs that would come with that. But if we could get a working stock android source code for the BH2 maybe that would be a win win for samsung. Get the ones willing to install roms, who are likely the ones signing the petition of their back while still forcing some to upgrade to the galaxy s when it comes along. Who knows though? Again this is only my humble opinion.
 
Did you guys know that a petition for the Samsung Galaxy (i7500) to get 2.1 exists and already has almost 7,000 signatures?

If 7,000 signatures can't convince Samsung to release 2.1 for the Galaxy, I doubt we have any chance of convincing Samsung to release 2.x for the Behold II. The only advantage we may have is their promise in the video that they would. Keep the pressure up!

Yeah the promise is what we have, that Galaxy owners don't.
 
I don't understand why Galaxy can't get updated its stock android...
Its simple they want people that bought the Galaxy to buy the Galaxy S. So they drop support completely for it. I'm starting to see that's how Samsung works.

Well, honestly the Galaxy might as well be a G1.. Same Ram & Limitation with the phone.

Even the G1 isn't getting any 2.X updates.

That's true but I just think that even with no limitations Samsung would want people to buy the Galaxy S instead of updating the Galaxy.
 
he is taking a poll @TmoNews twitter page to see if they should run the story. tweet to him and say YES...maybe i was wrong, maybe they are journalists after all.

What Poll ? He had the information provided to him DAYS ago. Even DroidDog John when presented with the information at the same time took long enough to get it put out there.

Not to chatter OFF, but it was 4 ( or was it 5 ) of us in the #behold_II channel on IRC that first night that he notified us of what he'd heard, and we all discussed it. Eugene was with us for a while ( though justifiably, a bit ticked off ). I went to youtube, found the four videos, plus the video of the Omnia II where the same spokes-mouthpiece hawked that handset, posted the different links to them.....at the same time, a few of the others were trying to see how far up the tech support chain they could get.

I then looked up who the owners of phones-online.net were, and it turned out to be some folks out of China that remarket cell phones of different brands. Then I dropped a note to the domain owner of "phone-online.net" to see if we could get some independent corroboration of where those video's provenance's came from ( some folks had questioned if Samsung had even made the Behold II's videos ). No response thus far from that inquiry.

So if any news outlet ( and those two WEREN'T the only ones that got the word put out to them last week ) took it's sweet time getting the word out, it's because they might not want to nibble at the hand that feeds them. Remember that they all are probably SALIVATING at getting their hands on a Galaxy S for an extended period of time ( and possibly that new "Vegas" phone that's supposedly coming to AT&T that the ROM get leaked from ).

If anyone wonders......this is xencoder from AndroidSpin. 'nuff said. Eugene got us the word, we took it and ran with it. If the bloggers are finally catching up, great, took'm long enough.

And to those who might say that Samsung might be able to squirm around this, it all boils down to perception. The iPhone intro next month will garner A LOT of publicity, other handset manufacturers will want as little negative press, as possible, to begin with.

A petition is good, but a call to your State Attornies office could be even more meaningful. We shouldn't have to start a class action ( I had been for it, but now not so much ), because if enough state attornies get contacted, then it gets a little more involved to ignore. Especially in those states that have laws about verbal contracts being legally binding. What's more, it could be said that the fact that they pulled advertising material to avert ( notice that there are still 3....yes...three...other Behold II marketing videos up on YouTube through phones-online.net ) they pulled the ONE(!) video that reflected negatively upon them.

Seriously, why pull the ONE video, why not pull all ? If someone were to back me up as a reporter or correspondent for their site, I'd be willing to actually call up the folks at phones-online.net in China ( the guy has an english name of Kevin, registered ) and for the record ask why the video was removed. And regardless of the outcome, put out a news item that they can publish about the subject. The next step being to contact Samsung Mobile PR for comment about the comments from the folks in China and/or whomever at YouTube can corroborate if any written reason was provided for the removal of the original video.

Yeah, I've got that much Chutzpah built up at this point, that I'd love to do it, just to hear what they have to say for themselves.

Anyway, sorry for the rant. Just trying to get a little bit of the record straight and history to this story. Keep up the good work guys !

This is quite disappointing, really I thought Samsung was one of the better consumer electronics companies out there. I purchased this phone just TWO months ago thinking it was the best option at the time, and now it seems it's been pretty much made obsolete.

Sure the first unit's screen failed, slowly corrupting row by row, but I just figured that was due to it being an OLED with a higher failure rate. with the replacement I've had pretty good luck it's been reliable and hasn't had any of the severe bugs others have mentioned.

it would have been nice to have an update so I could use the latest Google maps with turn by turn directions.. I really think it would be a big surprise if it did get any update though. With this news, and the directly observable fact that my phone still hasn't gotten even the bug fix from February, I really doubt it'll even get 1.6.

Way to go Samsung you effectively made me do an about face opinion about you and I will now no longer recommend your products to friends. I'll also have to seriously consider buying any of your products in the future.

As for T-mobile.. this disappointment added with some other service issues is really making me think I'll switch providers once my contract is up...
 
I called T-Mobile today and the rep said if this news is just on "blogs" T-Mo isn't going to act on "rumors". I bought the phone with a store rep telling me that the phone will be updated while showing me his Behold II. This was two months ago.

I will be calling my State Attorney General's office on Friday, I would advise all of you to as well just search for "(your state) attorney general". We'll see what has to be said. I'm not quite sure on MN laws regarding advertising and such. But what if the Samsung rep they get says it's coming just to avoid the legal system? Bigger trouble for lying maybe?

I was just thinking about creating an app to address this today (to hopefully get a larger audience to sign the petition). I have an app for the Behold II (Android Settings for Behold II) with about 500 active installs. I will push an update for that app and include a link to the petition as well. I'll work on it tomorrow. If somebody can work out a paragraph or two I can use, as well as any relevant links, I would greatly appreciate it. I know the info is all around this forum. It would be great to have a sticky with the most relevant and up to date information about the 2.x update/petitions/etc...

I feel really sorry for you guys, Samsung sold the phone to you with the promise of an update and you're not going to get it!

I could rustle up an app as soon as I get home tonight, and I have an app called WaveDroid with over 16,000 installs so we can get loads of signatures!

So, should I make a seperate app or combine it with the Hero one?
I could combine it with the Hero one now so I think I will do that, post back later!

Anyway, I've already changed it! I've got it more towards the Behold 2 than the Hero because I'm really appauled at the situation.

The discription on the Market has changed straight away, but it may take a few hours for the change in the app to fully propogate.
