Help Cyber Stalking! How to prove & Stop

Hello! This is the first time I've ever asked a question in a forum! I would like verification that cell phones don't come rooted, they can't rooted themselves or is something I could have done by accident! That if it doesn't have an SD card or has never been connected to an external hard drive & not set to back up data, it shouldn't have stored data in an external storage hard drive (which is hidden)! I can go on & on about all the different issues but basically what & why I'm asking is I want to be able to explain to my lawyer & judge what exactly shows that my devices are being accessed remotely! Every person I've talked to (even though they're suppose to be IT people) they try telling me to reset to factory settings or installing malware! I have been hard wiping (I think that's what it's called where you go through the IT steps holding the power, camera & volume buttons to get to the reboot menu! It's a little different depending on phone)! I also set up encryption on my last 2 phones & my phone I just got, I set up with VPN & encryption before I brought it home! This is a major issue for many people especially abused women & should be easier to get help from the companies we pay for their services but it's impossible to resolve! I had to go through 5 levels of security at HP to be able to reset Administration password cuz right after I set it up with my Network & Administration Password it was changed to a different Network all together! I just turned it off thinking it couldn't be used. It was off until I had to use the fax & left it on. It started sending faxes to my husband's work number. I looked at history & saw months of data transferred, so I called HP & I was told it wasn't possible. I finally got very upset & went off. 5 people & 3 hours later, I was walked through the process of resetting it but when I asked what they would do about it, being remotely accessed, they told me again it wasn't possible! I apologize for the very long & probably confusing message & it being a complicated, personal issue! I greatly appreciate any information you can give me!

Depends on what phone we are talking about here. And where it came from. It's not uncommon for cheaper non mainstream china phones to come out from factory rooted, or for second hand devices to be so.
 
Have a look at NoRoot Firewall at the play$tore.

It can be configured to allow or deny phone accesses for each application on your phone.

If you come across the suspect access, just deny the access using the NF app.
 
Really the only way on a device like that to remove any spyware would be to run the correct RUU for your device.

Most spyware will be disguised as a system app and will require root.
Usually the lower end spyware is easy to spot as it will have a ton of permissions.

Only one person that i know personally sells spyware that doesn't require root access. He is international as well and charges a hefty price. His app setup is the most advanced spy app i have ever seen. He also does it legally in his country as he's a private investigator.
