Help Erroneous battery meter

I have the LG Transpyre, VS810PP running on 4.4.2 and have suddenly encountered a problem with the battery indicator being wrong.
This is a brand new phone I've only had for a month and have had no problems before now?

Here's what happened,
The other day I was at my friends house without a charger. I'd been running low all afternoon but the phone finally died. When I got home I just plugged it up and let it charge for about an hour before turning it on.
I remember right before I powered on , the charging screen while powered off was showing 38%.
I got power button and started Android and suddenly it jumped from 38% to 60%?
Ever since then it stays stuck at 100% after full charge until it suddenly DROPS from 100 to like 70 or 60%?

What happened?
Is the phone shot?

To be honest with you, if it's only a month old it still must be under warranty so the easiest thing would probably be to take it back and either have it fixed if there really is a problem or get a new one. However, this is the app that a lot of the mods themselves use here for battery related issues. You can give that a try first if you want to and take it from there.
