Faulty Market Icon

I cannot access Android Market on my brand new HTC Hero.

Clicking on the Market Icon results in the initial registration box coming up with the "Accept" option greyed out. After spinning on for a while I'm told the application cannot be accessed - "try later". Pressing "Decline" does not get me anywhere either.

Is there any way I can fix or replace it?
 
Make sure you can access the mobile internet and are also connected to a WiFi source and try again. I was just setting up my phone after changing roms and had a similar issue as o had not entered the connection settings
 
Thanks, but I have checked and it still does not work. I have the feeling I need to repair or reinstall it in some way I can't figure out. Would updating the OS be helpful - although I guess I have the last version?
 
Are you sure you entered the correct username and password? If yes you might need to do a hard reset instead of reinstalling the os. You will lose all of your info but it should clear up any issues
 
I guess I might have to do a hard reset. Is there an option for that in one of the menus? (bit of a novice eh?)

Well, tried hard reset as well. Both from menus and from keys. No change. Clicking the Market icon just resulted in the screens shown above. I suspect there is a bug in the launcher program the icon points to. Does anyone know whether this programme can be downloaded to the phone separately? Would it help to install the OS anew and in that case, how? Grateful for any help.
 
if i was in your shoes i would log out of my google account and then try to log back in. if that didnt work i would do the following (i have not done it as i have never had this problem on my magic)
try going into
settings
applications
manage applications
scroll to market
clear the cache
clear defaults (if the button is active, mine isnt)
then try again.

if these suggestions dont work try returning it for a new one, if possible
 
Thanks for the suggestions. Think I'll try the last option and have now contacted the dealer to see what they can offer.
When something like this happen on an Android phone it is absolutely crippling. The whole point of owning it is gone and if it can happen to one phone it can happen to others.
I'll post information on the solution Handtec offers.
 
Handtec offered to send it back. Easiest solution I guess, but I still would like to know whether anything could be done to fix the problem.
