He wasn't a sharpie..but was the reaction warrented?

OK, let us review the facts in the case so far: He violated a city ordinance and he vandalized public property.

Perhaps an arrest might dissuade other kids form doing the same.

If yiou think the ordinances are unfair, then change the ordinance.

Seems quite clear to me.

I do not see an arrest as warranted though. I wonder what the phone call was like. If anything... it should have been a suspension at the MOST and perhaps just detention for a week or something. Having the police involved is just silly.

So apparently, the little darling was "seen writing on the desk with the marker."

So how do you interpret the story? Perhaps the writer means the student was writing on paper that was on the desk and he was not actually defaceing the desk; the ink bled through the paper, thus defacing the desk?

What does it matter, an innocent desk was defaced and that is tragic to be sure. It will be scared for live. God, think of the desks...who will save our desks?

Or the writer means that he used the marker, it bled through the paper, and the student started defacing the desk by writing directly on the desk?

The piece does not make it clear, it simply says he was seen writing on the desk.

If the report says he was seen writing on the desk, he was writing on the desk. He broke a rule/ordinance and he needs to be sent away for life.

At the risk of turning a tiny little molehill into a big mountain, look at the ordinance. If he was caught writing graffiti on your garage door, "Apple Rules and Robots Must Die" or some such, that is a violation of a city ordinance ostensibly written to try to curb graffiti. Does age really matter?

What is the punishment to be then?

Perhaps calling the police was a bad idea and it should have been handled differently. Perhaps the punishment should be cleaning graffiti from the public square? A day of butt breaking work might send a good message without involving the coppers.

I suggest the police send him deep into the heart of gang territory with a brush and bucket to remove gang graffiti. That might prevent other kids from damaging property.

Resources well spent. Suspension sure why not, but arrested? He's 13 are they going to try him as an adult?
 
My view is like this... it seems that the school has to resort to involving the police in order to maintain discipline. If that's what they've got to do, then fine, do what you have to in order to maintain discipline.

HOWEVER, once this is over there needs to be a review to replace the administration of the school with personnel that can maintain discipline in house, without involving the police.
 
Its sad to say but schools involve the police so they dont have to deal with the parents. You know the parents will be hot and the way everyone is sue happy now a days. The school boards dont want to mess with it.

Now on to the boy. It was overboard calling the cops. All they could of done was made him clean the desk. Like they did to students when I was a kid.
 
hmmm I remember writing "<name> was here" on a school bathroom stall with WhiteOut when I was in 4th grade....... had to remove the WhiteOut and got 2 swats (I can remember when timeouts werent used as discipline, no wonder we have so many freakin ******** running around now)......butt stung for a few hours.... never wrote on a wall again....... lesson learned......... wonder how my life would be different now if for the rest of my life I had an arrest on my record..... just for something stupid.......... and in the case of this kid the marker bleeding through was apparently an accident...... guess he should be on deathrow

just to troll a bit more with it:

"A city ordinance aimed at graffiti says no one is allowed to possess spray paint or a permanent marker on private property without the permission of the property owner or the person in control of the property."

does this mean that unless Wal-Mart has an employee in the marker aisle specifically handing out permission, then you can be arrested for pushing your cart around the store with a sharpie in it?.... after all you wouldnt have permission and being in your cart means in your possession...... what if you had a sharpie in your car when you pulled into your buddies driveway? could he have you arrested for possession?

Perhaps..... PERHAPS, I say, when a city ordinance is violated, teachers must contact the police. Not saying it happened there or in this case, but if the teacher's hands are tied due to BOE rules, then the teacher is not to be blamed for acting too tough.

I say perhaps what we need to do is start punishing these kids that violate rules and stop worrying how friggin old they are. Why the hell do you think we have so many problems these days? I think it is because we are scared to send these little munchkins up the river.

yes the kid who was writing with a marker and it bled through his paper onto a desk needs to be sent up the river..... regardless of how old he is............ because some liberal city council member thought this was a great ordinance....... nevermind the fact that most likely every school district in teh nation has magic markers on their required school supply list at the beginning of the year......... I suppose if he hadnt used the marker he should be expelled from school instead

Not sure, but it seems to me that in the case of Wal Mart, the fact that they are selling these Weapons of Mass Calligraphy must, perhaps, I think, suggest, possibly, that some sort of defacto permission is given to the future gang tagger or parent of a child to posess these terrible ink filled weapons of the public calm on private property.

Is Wal Mart public property? Not sure if it is. another debate perhaps..

I mean you cant deny permission to your customers to posses these terrible weapons of poor penmanship or sell them in this case without somehow telling them it is OK to carry them on Wal Mart property.

I also do not think these ordinances or laws were created for logical and sensible folks that do not deface property.

Finally, if it is a law/ordinance, kids should be punished for violating the rules. Also, I do not know, but perhaps the teacher called to police because it is a rule that when a law or ordinance is violated the cops must always be called. Do we know what the school's rules are?

Apparently not every school has markers on their list. If you do not like the ordinance, seek change. Or are you suggesting that we should ignore the laws we do not deem worthy? You can always change a law or ordinance.

let's take a break from trolling for a second and consider the fact that unless it was a private school it is not private property and therefor the ordinance does not apply. this sounds to me like an abuse of power. i would wager this teacher probably has a history with this kid.
 
So in US schools, a student writes on a desk he/she gets arrested. When I was in school in the 70s, leaving your mark on the desk was a ritual part of school life.

I don't know what happens in China if a student dare do the same thing. The desks in my middle school are quite pristine.

Bob...Sharpies don't put graffiti on desks. 13 year old ruffians put graffiti on desks. Don't deny the rest of us our Constitutional right to bear Sharpies!
