it would be up to the cable company, if they left a live line hook up in your house, you can hook it to your TV all you want, its up to them to have the connections at the pole right.
had a friend in an apartment go through that, wasn't his fault the cable company used only 1 single line into the building and then connected it to 10 apartments. [if one person paid for HBO, they all got it, but not all got a bill]
I dunno- it's kind of like cancelling your cable service only to find it's still on and continuing to use it for months, then complaining when you get a bill. Or opting out of a new credit card fee by agreeing not to use the card anymore, then using it anyway & complaining when you get charged the new fee.
Maybe not the best analogies above, but tethering is against the VM user agreement unless you are doing it through an approved device and paying for it, period. If you do it, just be ready to accept the consequences if they decide to crack down...
