Consumers do have certain protections, but you may have problems by waiting so long to notify anyone of the crack. You should have a manufacturer's warranty, even on a refurb, but the crack may be assessed as physical damage, which usually voids a defect claim. If it was damaged in shipping, you can certainly place a claim with the carrier, but many have a limited window in which to make a claim. IF AT&T is refusing to honor their 30 day exchange policy because of the crack, you may not have much choice, unless you can provide documentation that shows you purchased the insurance.

If you bought it online and signed up for the insurance there, then your receipt should state that. BTW, I removed your email address. It's not a good idea to list email addresses in open forums. It opens you up to spam and possible identity problems.
