How to tell if a phone is brand new?

Is there actually any guaranteed way to know a phone is brand new?

Refurbished phones work and function compared to a brand new phone is near identical.

Hmmm...
 
Sealed box? Sold as new (at least here in the UK it would be illegal for a shop to sell a refurb while claiming it's new).
