How are you trying to download apps? You should be able to do it from the Android Market without issue. If you are trying to download from elsewhere, you would need to allow the phone to do that by selecting "menu=>settings=>applications" and then ticking the "unknown sources" box - this lets you download apps that are not from the market.
If this is not what you are trying to do, it could be because you don't have a connection to let you get on the market - you would have to turn on mobile data or WIFI, so you could access the market.

Welcome to Android Forum. Sorry to hear that. And to add to what guide member D-U-R-X said - you would have to sign in with your Google account to be able to install apps from the Android market. If none of these issues aren't related to your problem, then you might want to have the device checkout.
