I've fallen through the cracks...

In the last few weeks, my Eris has started to act up. It freezes more often, drops calls with full signal, and refuses to download apps that I know the Eris is compatible with. This is really the first time my device has acted this way (with any consistency). I have tried hard resets a couple of times and flashing various other ROMs... obviously I am rooted. I talked with my Verizon reps at my local store and they told me to file a claim with Asurion, but the insurance only covers water damage and accidental physical damage, not malfunctioning. I got my Eris at the end of November last year so my manufacturer's warranty has expired. Any suggestions on how I could get a new phone without paying $160 for a "certified pre-owned" Eris that was offered to me? I would ideally like to get the Incredible but even a fully functioning Eris would be fine for now. Any help would be GREATLY appreciated. :)

they have a deal going on now where you can "trade-in" your used eris for $132 and apply that towards a new phone with an upgrade. and with the incredible being $149 you would only have to pay $17 for a new incredible. Just go in to the store and talk to them about it, you should be eligible for an early upgrade considering your manufacturer's warranty is up.

I am on a family plan with my mom and brother... he just got a new job and needs a smart phone so he used the upgrade to get the Droid X. We tried to get them to let us use the Buy One Get One Free deal but since only one of us was eligible for upgrade we could only get one. We argued for a while but they wouldn't budge.

yeah i would smash it and get a refurb. thats your best bet, really no other way out of this one.

*waits for the screams of insurance fraud*

Honestly, I'd smash it/break it etc. Verizon sold you a device and a service for that device, but now you don't have a device to utilize said service (through no fault of your own) yet still remain locked in the contract for both. IMO, they should either offer you a new/refurb phone, or let you cancel your current contract with no early termination fees and start over again.

In all reality, they should really just extend the warranty on ALL of their phones to two years if that's what your contract length is.

I completely agree. I am on my second Eris, a refurb which is also acting up. I *hate* that I am stuck in a contract for data services I can barely use. Actually, at this point, paying the early termination fee would save money instead of spending 90$ a month on a phone that only works 6 hrs out of the day, and then only with spotty performance.
