My phone severely letting me down. Please HELP

my phone is totally stock. i have done one AT&T update successfully and i am currently running Nova Launcher.

i am phone is just really laggy. the best way i can describe it is its like a PC running at max cpu.
also my phone (the part where you actually make and receive calls) is absolutely useless. people cant hear me. i literally drop every call i make or received at least once. i have asked AT&T about this and all they did was give me a new sim card which hasnt seemed to help. i live in the heart of southern california so its not a lack of service issue.

all in all i really like this phone and i want it to work but honestly my captivate with serendipity was SO much FASTER and better.

how can i fix this? would a custom rom help?

any suggestions would be greatly appreciated.

Hate to break it to u but it looks like u got a complete dud on ur hands, return it
 
i remember when i updated to a newer version of serendipity on my captivate my phone (the phone part) stopped working. so i loaded a different modem or something and it worked great after that. could i do this?
