Help Phone.apk still crashing on 2.3.4

Well i was hoping with 2.3.4 coming out that the phone.apk crash would be fixed but it is stilll there
i have found out two ways to trigger it if the hang up first and the screen is on or you have your messanging service on at the same time.
There is a fix but it involves rooting
why we can not just install a apk to fix this i will never no with out having to root that phone

So there is a fix for this if you're rooted? Could you please tell me what that is? I have a rooted stock 2.3.4 JVR and phone, contacts and messages keep crashing.
