you are rooted if you have clockworkmod clear your dalvik cache or if not factory reset after titanium backup this should fix your problem

doesnt matter what rom whatever rom it is wipe data and everything else reflash the rom let it boot connect to wifi and dont try to download anything for about 15 mins the market updater needs to run itself or else youll keep getting error and you do HAVE to reflash the rom because you already screwed up the updater by trying to download something. Force Stop
Clear Data and Cache.
Back to All Applications > Market/Google Play Store
Force Stop
Clear Data and Cache
Uninstall Updates if Your Google Play Market is Installed
Restart Phone
Wait 30 Mins to an Hour before Starting the Market.
This used to happen on The Stock, CM7, and Miui Rom.

On cm7 but this has happened since my gf deleted my backups and God knows what else being spiteful so don't know why it wont download aps

As previously said, wipe everything. Re-flash the rom, let your phone sit for 30min to an hour.
