Help Screen is on all the time

For some reason my screen is not going dim when not in use. I know it was yesterday when I got it but today it won't.

I just called VM and she had me turn the phone off, take out the battery to reset it and then it worked.

She said this is a problem for Androids but should not happen and if it does I should return the phone to Best Buy and have them give me a new phone.

What are your thoughts on this?

It happened again. I tried to activate my phone and got an error message then it never dimmed.

I took out the battery and it is fine now. Do I need to get a new phone?

As an aside, my phone won't top up and I've spent half my day on the phone with VM. Not impressed.
