Help SD Card unexpectedly removed - not!

I bought a Kingston 16GB class 4 microSD for my Legend, dismounted the 2GB card that came with the phone, turned off power and swapped cards. I decided to do a hard reset to start over with the new card and waited while it booted. At some point before the boot-up completed the notification bar gave the message "SD Card unexpectedly removed". Sure enough, phone thinks card is out so the formatting option is unavailable.

So I remove the card and inspect it on a PC. A selection of folders are there e.g. .android LOST.DIR etc. and the card checks out OK. To check it for any defects, I low-level format it FAT32 under windows then run H2testw to check for errors and verify the capacity and speed of the card (knowing that there are some cheap knock-offs out there). The report shows the SD card is as advertised...

Code:
Warning: Only 15247 of 15248 MByte tested.
Test finished without errors.
You can now delete the test files *.h2w or verify them again.
Writing speed: 4.27 MByte/s
Reading speed: 13.7 MByte/s
H2testw v1.4
Spot-on for a 16GB class 4 (4MB/s) card.

SO, I give it another low level format and put it back in the phone - same thing happens again. Frustratingly, I'm unable to use the format function in the phone menu because by the time I get to the menu the phone thinks the card is out.

Googling around I see a few similar cases but nothing definitive. The seller of the card also acknowledges the problem and has offered a refund. Now I'm wondering what 16GB SD will work with the Legend?

I've changed display setting to shut down screen in 30 minutes, and i think this work.It look like there is bug in sleep mode/battery saving during the call.
