Yes it is technically copyright infringement on any contributor to the Linux kernel up to the point where the 2.6.35.7 was forked off from mainline Linux source, the infringement on anyone who contributed to the android kernel up to the point where the kernel source for this phone was compiled.
And if you can get people contacting and threatening them, something may get done. Not sure exactly how to file against alcatel/pcd for copyright infringement! But I'm sure it can be done!
