Sprint changes/breaking contract

About a week ago I read that Sprint was going to change some fee from .99 to $1.50, and that this change breaks the contract. Can someone direct me to detailed information on this subject? My wife and I have had some financial changes and I would like to either get out of my contract or maybe get some type of discount.

They should have the details in your most current bill. If not just call the retention line and ask them about the 'material change in contract'. They will let you out if you want out.
 
Verizon just raised their regulatory fee and I ported to Sprint and was successfully able to get out of paying ETF to them. Why leave Sprint though?

No one believed they would waive it for me, but if you go in understanding the terms and conditions they will. Sprint customer service is easier to deal with than Verizon too, so if this fee increase on Sprint is true (I haven't heard anything about it yet), you can possibly read through the terms and conditions and find a way out.

and per their terms and conditions:

"When You Don't Have To Pay An Early Termination Fee
You aren't responsible for paying an Early Termination Fee when terminating Services: (a) provided on a month-to-month basis; (b) consistent with our published trial period return policy; or (c) in response to a materially adverse change we make to the Agreement as described directly below.


Our Right To Change The Agreement & Your Related Rights
We may change any part of the Agreement at any time, including, but not limited to, rates, charges, how we calculate charges, or your terms of Service. We will provide you notice of material changes—and may provide you notice of non-material changes—in a manner consistent with this Agreement (see "Providing Notice To Each Other Under The Agreement" section). If a change we make to the Agreement is material and has a material adverse effect on Services under your Term Commitment, you may terminate each line of Service materially affected without incurring an Early Termination Fee only if you: (a) call us within 30 days after the effective date of the change; and (b) specifically advise us that you wish to cancel Services because of a material change to the Agreement that we have made. If you do not cancel Service within 30 days of the change, an Early Termination Fee will apply if you terminate Services before the end of any applicable Term Commitment.

Is an extra $.51/month worth cancelling your contract over? Well, I suppose if you were already looking for an out... Also, I don't see how that "has a material adverse effect on Services" (thanks falconey). Not that I'm thrilled to be paying an extra $1.02/month or anything.

My wife lost her job and we need to scale back for a while in our finances. If they won't offer me some type of credit or lower my bill, then yes, I'll have to cancel my contract. I'm not saying I'm definitely going to cancel, but not being under contract makes it one less burden when trying to juggle finances.

Well something like this is certainly for someone already looking for an out although in the past I've used something like this to simply go month to month. I like the leverage of being month to month. You get better customer service when you have that leverage. To your point though, the piece you quoted is really just lawyer speak. It basically means if they raise the price, they've changed the contract and you have the option to opt out of this change to your original agreement. For someone like me with 4 lines this continous nickel and dime raising of fees is getting expensive. Either way I'm still sticking with sprint.

That's me. We only have two lines, but I would really like to be month to month.

The best approach is to get the csr to let you out of the contract and then once they agree to that let them know you want to shop around before you cancel. Also make sure they send a confirmation email that you are let out of contract. If they say they can't ask for a supervisor. Good luck.
 
Where do I find the change on the bill? I have online statements. Do I need to go back further than my last statement to see it?
 
The fee change should be on your August statement. However, it is NOT required to have your contract cancelled. I didn't have the message on my statement either, but Retentions knows it's your right to cancel w/out ETF.

If you need to, read the following statement to the Retentions agent:

"If a change we make to the Agreement is material and has a material adverse effect on Services under your Term Commitment, you may terminate each line of Service materially affected without incurring an Early Termination Fee only if you: (a) call us within 30 days after the effective date of the change; and (b) specifically advise us that you wish to cancel Services because of a material change to the Agreement that we have made."

Remember, you have the upper hand. It's your right under the law and their T&S to be let out of your contract due to the fee increase. Immediately ask to be transferred to Retentions and be stern but polite. Don't give up! :D

I don't actually have a problem with my contract but since they wont help me with my Evo 3D maybe I can use this as leverage.
 
It's worth a try, however Retentions wouldn't offer me an upgrade discount or any other special offers. She told me they were instructed not to offer anything and to let customers cancel their contracts, or go month-to-month in my case. It probably depends on how long you've been a customer whether they want to keep you or not. I joined in June 2010, so that's probably why they gave me the cold shoulder. I was sick of my slow-ass HTC Hero, spotty service, and the addition of a year to my contract after applying my corporate discount. :mad:

Yep. I put Cyanogenmod 7 on it which helped with speed. But I still couldn't stream Netflix, watch Flash videos, play Angry Birds and more resource-intensive games, and a lot more. I was just ready to upgrade to a more high-end handset. The Motorola Atrix is light-years ahead of what my Hero could do.


Same here. I'm on the 3D now but plan to negotiate to month to month or a reduced bill if possible.

I am not sure what I am going to do yet, but it is always best to have options, when they have zero cancellation fees.

Too bad after they let you out of the 2 year agreement someone couldn't use that to sign a new upgrade with them to get 2 year pricing. :-)

Yeah, even though you are off contract the upgrade dates stay the same.

It's possible and if they let you out you will keep the phone.
 
I think that some of you are acting absurd. Sprint makes a change that amounts to a few cents and you all think that's a good reason to get out of your contracts.

Nobody forced any of us to sign contracts.... But we did. Just because they make a very small change you think that should relieve you of the responsability that you agreed to?

If Sprint came along with a major change I could understand.... but seriously..... Come on.

LOL, It's a contract. Can you call Sprint and say I want my bill lowered by a few cents or do you think they will tell you to pound sand if you ask them? And it's actually not a few cents. I'm not even trying to get out of my contract, but why would I care if someone else is? They agreed to terms and if those terms are being changed then the contract has changed. So if Sprint is changing the terms, logic should lead you to understand that you are already relieved of your "responsibility".
 
That's a ridiculous argument. Contracts and early termination fees are criminal extortion deplorably perpetuated by the American wireless industry. Don't preach to me about "obligations". My obligations are to pay my bill on time and stay within the allotted voice/data caps of my plan. I understand that you might be loyal to your corporate masters, but I am not. If I can find a loophole to escape from what I consider fascist restrictions then I will. What do ETF's do besides limit consumer choice? :mad:

Those contracts are in place for a reason, and you chose to sign the contract. If at some point you decide that you no longer wish to be bound by the contract.... put on your big boy undies, and pay your way out rather than looking for a way to skirt your responsibility.

So you are okay with people paying cancellation fees to get out of a contract, but when carriers raise fees that were set when someone signed a contract, you are not okay with them allowing the people out of the contract?

I did this for a simple reason. I have been with Sprint for almost three months now. I was having issues getting signal with the Evo 3D, they told me it was just the phone and to switch to a different phone. I got the Photon, and guess what same problem.

Now I was out of my 30 days, so I was going to pay the cancellation if I had to. But now I don't.

I understand some don't want or need to do this, I think that is good if you don't. But try not to judge others if they do, Sprint changed the fees and brought this upon themselves.

They have admitted this themselves by allowing people out of their contracts. If this doesn't effect you, then I don't see the problem.
 
Sprint told me they can charge $1.99 before I can get out of my contact. They screwed me on a full upgrade after a year and I was trying to get out. Don't know why people are saying they got out if they can charge 1.99.
