Text, voice typing = background data on

In ICS, just noticed that the background data must be on to use the little microphone for voice typing when texting. Otherwise you get a "can't connect" type error message.
My Droid 3 seemed to do it fine with background data off.
Another little annoyance. Any fix other than turning on background data?

I've got this same problem, but I DO have background data turned on. However, I've noticed that mine works fine when I'm connected a Verizon tower, but not when I'm connected to a WI-FI network somewhere.

Is there a way to force WI-FI to be the background data sync???

This is really one feature that I do NOT want to lose. This worked great before, and when it works, it works now, even better than before...
