This is a non-captivate question...Please help

I have an important question that i hope someone here may be able to answer

this has nothing to do with a captivate but seeing how most here are tech savy and what not i figured, this as better then nothing

My roommate, Alana purchased a used laptop off of Craigslist. The computer was damaged but it was under warranty and she shipped it in to have it fixed

Well before that she and the original called the manufacturer and had them switch the warranty and account information over to her name
and our school address and what not

But she finds out from the original owner that the laptop was sent to her instead of my roommate...and she isn't giving the laptop back.

My roommate has already paid the girl for the laptop for like 200 bucks
so she is out of money and no laptop

So what are her options?

When my roommate threaten to call the manufacturer to fix this the girl said that she could deny responsibility due to the fact she was not home when the package came and she could say it was stolen off her porch and not in use by her(the original owner).

Now i asked alana about how she shipped the laptop back to the manufacturer and she said her mother who is currently overseas shipped it off to them and that there was a case number.

Is this a lost cause?
Alana(my roommate) possibly has a case number to show that she called in about the laptop and a few emails but the emails do not show an agreement that they were making a definite deal...

or is this girl going to pretty much scam her because
the paper she received in the package with the laptop has her name on it
, the warranty is in her name and she could easily deny liability of the computer seeing how she wasn't the one who shipped it to the manufacturer and the manufacturer shipped it to her(mistaknely, i am assuming)

is there anything we can do to rectify this or trace it or is it a lost cause?
Sorry, if this is wordy...We've been googling stuff all night trying to figure this out

I understand that you "know" and are "friends" with the members of the Captivate forum, but the Lounge is where this belongs and is also where you will be able to get the most/best help from ALL the users of AF! :)
 
I have never had a problem with craigslist myself,


But if you wanted to, you could press charges if you have the emails/phone logs/and any sort of proof that:

A: Your roommate and the seller both agreed to do the transaction at $200
B: The Transaction happened
C: You called in to warranty with the owner to get everything switched

Im sure you can dig up some evidence for those 3 things.

but I think id just threaten to press charges first, telling her you have proof etc and see if the gives in or not. It sounds kinda petty, but in that situation id be so mad, i would be blowing steam out of my ears right now


remember, she is the one who tried to scam your roommate, which makes her dumb as dirt. So use that to your advantage!
 
Your roommate could call the manufacture and put in a claim that she never received it, (which is truthful) since you said she did update the address to yours.

Small claims court is another option, but for $200 it may not be worth the trouble and time.

The thing is, this girls seems smarter than i gave her credit for

The emails do not directly say they were meeting or that they were going to do the transaction for sure.

My roommate gave her our dorm number to call...So it makes it difficult

Another thing is, since the girl didn't sign for a package she can deny liability because she technically didn't send it in nor did she have knowledge that my roommate sent it in
so really she got the comptuer by mistake which goes to help her case because if she was not expecting it then she can easily say it was stolen off her porch or wherever

so in small claims court, the case really is

Alana(my roommate) brought a used computer of craigslist and the warranty was switched over to her name....She sent it in to get fixed, it got fixed but was delivered to the original owner who won't give it or the 200 bucks back...

THE Original Owner has the paperwork that has her name on the paper as well as her address and alana at most has a paper that shows she mailed something into acer but not necessarily this exact laptop

So is this really worth fighting?
I dont have a problem giving her 200 bucks...money is not the problem
but i dont want to waste my time in court if we have no chance
 
The problem is when she sold the computer to the roommate she switched the warranty and information over to Alana's name...the phone was on speaker so Alana know she was calling them for real

I can't blame UPS or FEDex or whoever delivered and to a certain extent, I don't blame the girl really...

This is the manufacturers fault...
If the girl(Brittany) switched the warranty over to Alana then why in the hell did they send it to Brittany the original owner...

In fact, when Alana's mother sent it in for her...she would have to have sent in an address(I am assuming) with it...her mailing address to have it sent back

so why would they send it to the original owners address...especially if she asked to be removed
 
i think .... from what you have said...

the manufacture is at fault..
the manufacture sent the laptop to the wrong place.
Shipping sent it based on the packaging slip.
The seller got a product by mistake. she should have done the right thing and sent it back.

Alana needs to verify that the warranty was changed correctly. then she should go after the manufacture for loosing your product! They should cover all cost to replace.

then the manufacture should go after the seller to get thier product back or sue for loss.. either way.. it is not your problem to fight the seller at this point!

there are 2 situations:
1. alana vs manufacture
2. manufacture vs seller

they are independent of each other!

I just want to help as her roomate and friend because i dont understand how people can be so cruel

But here is the deal...
She called the manufacturer(Brittany, the original owner) and told them that a package was delivered to her house and stolen...Only the box was there and she "pretended" she was pissed off about it and making a big deal

She called my roommate up and told her point blank there was no way for her to win.
Now she already called into the manufacturer as "Alana" to get them to switch the warranty back over in her name...Alana called and they told her the name on the account was Brittany not Alana.

My question is
if we were to pursue legal options

Can Acer actually trace the number back that called them on Friday?
i know they record calls...
But i mean can they trace that very call back to the phone number that called friday that requested it be switched over....
 
What about email sent to Alana when repair order was created? This is usually standard practice. I would have to believe that there is some sort of electronic 'paper' trail. Barring that i personally would engage in some e-revenge. Posting of all Britany's info via facebook or twitter, childish i know but so are her actions. Not familiar with craigslist but is there some sort of negative feedback you can give there?
