Verizon Gets Approval for AWS LTE

The spectrum that Verizon currently uses for LTE is subject to conditions agree upon when they purchased it. These conditions prohibit Verizon from blocking devices that are compatible with that frequency access to their network, similar to gsm networks. By offering a frequency other than the one these conditions are on, it might make enforcing these regulations difficult.

As I understand it this is also what prohibits VZ from throttling LTE bandwidth over data use.

Yes, this has been the case. They can still throttle if the tower is "over congested", but it's not a month long throttle like at&t or t-mobile.
