he could sit and watch and hope the victim was rescued .. but keep his job.

do the right thing and try his best to help.

what would a common individual do?
cant believe the boss would fire him for doing what he was trained to do.
was there other reasons for his dismissal that was not released to the press.

how would it sound if he had told the person that pointed out the victim... sorry he is not drowning in my protected area..victim died.. and that got to the news.

would he be criminally liable for indirectly killing the person??
 
those points are valid.. but not in this case..

this case .. a lifeguard is trained to help people in water.
a person is asking for help/assistance... in water

yes..i also understood he was fired for leaving his post...
but if a building was on fire.. or bomb threat.. should workers would get sacked for leaving the building???

i am just saying.. that the bosses at that company were harsh in this situation.

a doctor.. who has training and experience with a particular situation..
he is touring outside the hospital..
someone is in medical trouble..can die if not taken care of now.
he has the ability to help...what should he do?
"here is my business card.. call and make an appointment to come into the hospital.. better hurry"

He should have let the person drown. He knew his boundaries and he knew the consequences. He should have told the person asking for help that the drowning victim was SOL. Its policy for a reason. Speaking of policy......

While i normally would agree the issue at times isnt the judge as much as it is the law. The issue are those that take advantage of the law. In this case the courts should have investigated the parents. In Georgia if a child has 10 unexcused absences the the parents could face jail time. I disagree with this law and think its stupid because i am out working to support the delinquent. However there are those parents that know their children are not going to school and dont care. So it really becomes a question of Where do we draw the line

And what does the law say? Judges might not always want to do the "right" thing and therefore, they make a bad ruling in the eyes of those that do not know anything about the case, the kid, the parents or the laws.

I know a lawyer that mentioned a judge who sent someone away for something like 8 years for a very minor infraction. The judge was stuck because of mandatory minimum sentencing laws.

and I think we need to start drawing more lines. Apparently the child was a hard worker and an AP student. That really does not mean much if there is a specific lay in place.

If you are trained to save lives, that is what you do. If there are rules in place, you obey them unless circumstances force you into a situation like this lifeguard faced.

So, if you forget the rules and orders and you save the person you are fired.

If you let the guy drown knowing you could of saved his life you are fired for going the extra mile; if he is saved you are fired for disregarding the rules.

If you let him drown, you are sued by the family and criticized by the press as well as the city you work for and the company. If you accidentally hurt the drowning man, you are sued because you disregarded the rules of your employer and the city.

In other words, you are screwed, regardless of what you do.

I once stopped a friend from aiding a little girl crying in mall. Apparently she was lost. She was in a secluded area near the entrance to the service areas.

I told my friend, in this day and age, someone might get it in their head you were molesting her and an overzealous prosecutor and child "welfare" worker can put words in the child's mouth and my friend ends up being a child molester.

Doctors fight a battle with their insurance (as do nurses) and these days, sadly, doctors must be very careful. One big lawsuit and they lose coverage, When that happens, they are in serious trouble.

That said, let me ask what you mean by "he is touring outside the hospital." I am not sure there are restrictions that limit a doctor to only practicing in the hospital and no place else. But then again, I am not a doctor.

Good doctors likely say to hell with administrative rules and they go ahead and save the person.
 

Tooooooooooo many. Or perhaps not that many adjusting for the increase in the percentage of population and a flat growth rate in the nut ball population. If the idiot level remains historically constant based upon incident numbers rather than percentages, the percentages can actually decline as the population increases.

To answer your query, toooooooooo many nut-bars roaming free. Too many sensitive people that take every insult as a capital offense. Soft people that cant bear that their precious children were called mean names or that someone unfriended them on Facebook results in gun play or lawsuits.

Wimpy parents that think the worse thing is a child with a cut because he or she fell down, so a lawsuit forces a town to replace asphalt with rubber.

I blame the web where every minor infraction is played up and repeated constantly so a tiny little thing because a major story. I blame society for raising malformed intellects and crappy parents who think their kids are special. We know they are not special, just over protected.
 
Hmmm, so I guess you think when someone is speeding, running red lights to get a loved one to the hospital because they need emergency treatment, those individuals should be ticketed for speeding, running a red light etc? I mean, "we cannot create special laws for every possible exception" right?

Tough call.

Your heart is in the right place, but the sheriff is at your door ASAP if you hit and kill my loved ones. You will be served with papers and you go to court to fight a lawsuit because my loved ones are worth more to me than yours.

I can see your point and it is natural to want to help. That said, if you put your life in jeopardy or the public at risk, whatever points you get for saving one life is cancelled out if you kill someone in the process.

Most people do not have the driving skills to speed and run red lights.
 
The word bullying is thrown around way too much these days. If I got it right, the girl had been making prank phone calls to another girl. What have we come to when prank phone calls are considered 'issues with the law?' Punish her, fine but 30 days incarcerated and have her hair publicly cut? That kind of seems like eye for an eye.... great when dealing with a murderer/rapist (and I mean great) but too harsh for a 13 year old pulling some shenanigans.

Perhaps, but it does send a message, does it not? I mean, when word spreads through the school that you go away for 30 days with a public hair cutting, it might stem the tide a bit.
 
This doesn't set well with me. The victim is just giving the public a warning about sexual predators.

At least in this case the judge and prosecutors hadn't entered the fray. With the public outrage, doubt judge would have ruled in the rapists attorney's favor, as the rapists had posted pictures of the rape on the internet.

Sorry if some one has brought this up already, tried reading all the post but was getting a head ache.

Did she miss school to go to Jail?

Nice to see Socialists in such large numbers here. This law and the whole mentality that every kid should get an education even if people have to be jailed is Socialist and even verging on Fascist.

Don't get me wrong Im not a ********* who thinks the Public Ed should be abolished with SSI and ....

But you don't make free people do anything and if you are being forced to do something well you are certainly not free.

We are in the Dawn of a new type of law in America, Compulsory Law. Law used to be about what you were not aloud to do, but couldn't make you do anything. You had choice.
It started with the Sex Offender Registry which was one of the worst things ever to come out of Washington. It is compulsory law and any one on it has no freedom. They are expanding it more every year, in my State some of the offenses that Get you on the SEX Offender registry are non sexual. Misdemeanor non sexual Contributing to the Delinquency of a Minor or Non sexual Abduction. Well in this State Misdemeanor offenders are on the registry for life just like Felony Offenders.
Pretty soon they will drop the Sex and it will just be the registry.

What has it done for us, nothing, a study by the Fed shows statistically it hasn't had an affect either way.
Then we get more of this with Obama Care. Compulsory!

Then all these laws like truancy aimed at protecting us from our selves like in this girls case.

Yes school is important for the kids who take advantage of it. But in my opinion making kids go who are not taking advantage of what they are being given just wastes our time and resources that we could spend on students who deserve and have earned it.

The Judge is following the law here so you can't fault him for that but it seems he believes in this law else he wouldn't be using it to make examples.

Free people don't need to be protected from themselves, its my right to screw up my life and the only real complaint I saw in any of the posts was people ending up on welfare(Which Im sorry sounds more like greed than Political belief) well a Welfare State is Socialist by nature so wave goodbye to your freedom and beg your masters to not be cruel.
