Date you ordered and received the phone vs. "will ship by" date

My only concern with this is for those people who did it online - is that 'mail'? I doubt it - they probably have us on a loophole there.

6/4 here, expected ship, tomorrow...(6/25) I am in maine.... seems like it may be falling behind tho :( I better have it by weds! I was originally hoping to have it tomorrow, but over the past few days it seems they have fallen further and further behind. so going by my ship date, I should have it by tues, now it seems it will be weds..... at the earliest.. FML

I'm a 6/4 as well. My VZW biz rep said that his order have been shipping according to schedule. With that being said, ours should ship tomorrow!

Shopping by phone or mail is a convenient alternative to shopping at a store. The Federal Trade Commission’s (FTC) Mail or Telephone Order Rule covers merchandise your order by mail, telephone, computer, and fax machine.
Mail or Telephone Order Rule

By law, a company should ship your order within the time stated in its ads. If no time is promised, the company should ship your order within 30 days after receiving it.
If the company is unable to ship within the promised time, they must give you an “option notice.” This notice gives you the choice of agreeing to the delay or canceling your order and receiving a prompt refund.
There is one exception to the 30-day Rule: if a company doesn’t promise a shipping time, and you are applying for credit to pay for your purchase, the company has 50 days to ship after receiving your order.
 
Well I was thinking about a complaint to the Attorney General of each of our States. In the State of Virginia a Promised ship by date in writing is considered a contract. Since they failed to meet the Ship by date they are in Breach of that contract. Since my order exceded $300 (phone, car charger, case, ect) it makes it a felony.I would be seriously interested in seeing what the Verizon folks have to say about that.

Come on, folks. It's a $150 piece of plastic and silicone. we all ordered them knowing full well they were back ordered indefinitely. Exercise a little patience and stop cluttering up the tubes with these inane and implausible scenarios.

You'll get your phone when you get it. Now go read a book or ride a bike.

ok this sucks hard.

guy with brain just told me that my order had been upgraded to overnight shipping along with several other 1st of the month orders, but he couldn't tell me when it would ship. He said it looks like it could be today or as much out as the middle of next week. when/if I get it, it will be going back. That is after I have played with it. I will be getting a droid x.

If I had a better choice of carriers for areas I travel in I would dump VZW I have been with them 7 years and this by far has been my worst experience. I asked the rep if he could give me a refund or the restocking fee or credit toward the droid x and he said they arent doing anything with the x's right now.

I know this is not VZW's fault, however they should have a better IT department so that they could handle shipment updates.

My gripe is I have been told several times my order is pending shipment and to call back to get tracking or have it texted since my email isnt tagged and now my order is marked not shipped and VZW hasnt contacted me to let me know.

First off you don't need a lawyer to write to the Attorney General.
Second off. I have much more than $150 Dollars rolled up in this deal. There is a principal involed as well as almost$1700 once you include phones, equipment, paying an extra month to AT&T for original delivery and now having to pay an ADDITIONAL month of AT&T because the phone was not delivered on time. This is not how business should be done and after spending almost 7 years with AT&T I am beginning to think I should have stayed there.... now any other smart ass comments?
 
Now some interesting info, the FTC has a rule called the Mail/Telephone Order Rule. Basically says if the seller advertises or tells you a shipping date, and is not going to meet it, it must give you notice, and give you an option to cancel your order and get a refund, or accept the delay.

For those of you who were supposed to get it shipped already, mention this rule to CSR and I bet you get somewhere, or else you can file a complaint with FTC.

Basically while it probably won't help it get shipped sooner, regulation requires them to give you a refund, not make you wait till the phone ships and arrives and send it back. Especially good for people who have decided to jump to Droid X

Interesting. I did a quick look around and this rule DOES apply to internet orders as well. It means that the people who were supposed to get their orders shipped, say, yesterday, but didn't, should be entitled to cancel their order and Verizon can NOT assess any kind of penalty for that.

Hmmmm ... now do i really want to cancel this order? Apparently, contrary to what the Verizon schmucks are saying, if your "ship by" date has come and gone, you very much can.

Sure wish people who ordered in store had some sort of recourse. We ordered 6/8 and our cs rep said it would ship 6/10! :rolleyes: Wish I could go kick that guy in the taco right now!
 
LMAO i ordered in store 6/10, the lady told me it would take 2 weeks and i can expect it at around 6/26. LOL LOL

Yeah...when I called back on Friday (6/10) to get the tracking number I talked to another CS that said, well I have no idea why he told you that, we're telling everyone 2.5 weeks! Fockers!
 
When I ordered in a store on 6/4 the lady was doing the order and she said wow...it will not be here till the 24th....well that got changed 3 times....as it stands right now it will ship on the 25th....no way I am calling today after what everyone else is finding out...lol
