Verdict - 30 Day Period from Launch

I am in the same boat. I have until next Friday to make up my mind. I will more than likely stay with it. I guess I am going to have to call Sprint again tomorrow. I am currently waiting for my replacement from them and if they currently have them in stock I am wondering where my replacement is. I was hoping to have the replacement in my hands before my 30 days was up.

I'm in the similar boat as you, but I'm not thinking of exchanging for anything but the EVO.

Here's the thing, you said you're on your 2nd EVO? What date did you have that replaced? Best Buy's return policy starts from the day that you picked up the device. I confirmed that when I went back on Tuesday night (after my 2nd phone bricked from the software update).

The Best Buy I originally went to allowed me to put in a pre-order for the white one and indicated that my order was a "Priority Exchange." Since they didn't have any EVO's to replace my bricked phone with, they felt bad because they also couldn't give me a loaner (only way I could get a working phone was to do an exchange for a blackberry or moment or hero, but I wasn't about to mess with the transactions I already had in place). Their "loaner phone" policy apparently only applies to phones that have the BB service plan and that particular phone needs to be "shipped out" for repairs.

SO, even though I originally purchased my phone on June 4, I got a "replacement" phone 21 days later on the 24th, so that means my "new" 30 day exchange end date is 7/23. In the meantime, I'm just gonna keep checking back with all the Best Buy's every day, in case they get any in stock (so I won't go phoneless). I originally was told that July 7 would be the release date for the white EVO, but I was mis-informed because I was told yesterday, 7/11 is the release date.

I tried the closest Best Buy 10 minutes after opening and the mobile department was already swampped. Frustrating not having a working phone, but nothing else I can do.

The only "alternative" option I had was to go to Sprint because I was also told Yesterday (from the Phone Tech Support) that HTC shipped out a bunch of EVO's to Sprint because it was their fault that the software update caused so many phones to be bricked. So Sprint stores "supposedly" has EVO's in stock, purposely to replace phones that were bricked from the software update. The reason I didn't move forward with that was because it would've voided by Best Buy 30 day exchange, so I chose to wait.

This is huge for me. I got my EVO from Best Buy on launch day and exchanged it the same day due to dead pixels. Then I exchanged again on 6/25 twice due to light leakage. Do I now have 30 days in my return period from 6/25, meaning that my last day to return and cancel my contract is now 7/25? That would be awesome as it would allow me plenty of time to see how my new EVO holds up. Come to think of it, it seems fair for the return period to restart so that a customer would have that 30 days with their replaced device the same as they would have with the original device. Can anyone 100% confirm that I have a new 30 days and not just the 30 days from the original purchase on launch day?

You have until 7/4 on your contract and the phone.

Exchange and Return Period
Exchange or return your item anytime from the original purchase date within the timeframe below:
14 days for computers, monitors, projectors, camcorders, digital cameras, and radar detectors
30 days for all other products
45 days for all products for Reward Zone Program Premier Silver members

I have my EVO from launch day. No problems at all. My battery lasts the whole day and some. I like the Evo, but I saw the Samsung Epic and seems better. It has a better processor and Super Amoled. If you compare the videos with Epic and EVO you will notice the difference. Also games look much better in Epic. What to do? I have until tomorrow. Nobody likes the Epic?

Got 2xEVOs on launch day, we love them. You can try and pry them from our cold, dead hands!

I have really been enjoying my Evo, my first smartphone. The Android platform is amazing. But I still hate the lack of a physical keyboard. If I knew that the Epic 4G was launching soon, I would have waited to upgrade from my Samsung Rant feature phone. Now it looks like Samsung may get my business again when the Epic 4G is finally released. Besides the keyboard, the screen res and other features sure do help!

One local BB put me down for a raincheck for when they arrive and said he would honor my 30 day return policy. Another local BB, the girl just wrote my name down on a piece a paper in a folder. So frustrating....2 more days left and no sign of a exchanging my EVO that keeps randomly freezing or rebooting. (yes, I've done all the updates, etc. etc.)

I've never been an early adopter of technology when it's released, but this EVO was so trempting. Now I know why I've always waited a month or so. DOH! haha

I'd go down to the Best Buy that you're waiting on an exchange for and ask them, just to be sure, but that's exactly how it was explained to me because technically speaking, the new device that you exchanged for is actually a "different" unit.

If they give you a hard time about it (which they shouldn't), just give them an example that if you had exchanged the EVO for a Blackberry or another Android device, technically speaking, that's a different phone and you should have a new 30 day exchange with that particular device. It's the same type of situation, except you really just want to have another EVO that works properly.

From what I understand, the manager has to "approve" extending the 30 day exchange, which they were happy to do for me in my situation.

The good thing is, if you really do hate the lack of a qwerty, the EVO would still probably go for a darn good amount of money on ebay, by the time the EPIC comes out anytime in the next few months. So, you may end up having to pay full price for the EPIC at first, but you'll make the money up by selling your EVO.

Don't live your life according to other people's likes and dislikes.
If you want the Epic, get the Epic.

I got two conflicting answers in this thread. Does anyone know with certainty if an EVO exchanged on 6/25 gets a NEW 30 day return period until 7/25? I need to be certain and I am not confident that asking at the store will get me a sure answer either.

To the poster above who said "I was told by in store reps and the Tele-sales rep. July 2nd is the last day to return. Just a heads up." Why would this be? That's less than 30 days. My calculations put 30 days on July 3rd. Not saying I know, just asking.

The 30 days starts from the date of activation. Not the purchase.

I wanted to return mine at the sprint store but they wanted to charge me a $ 35 restocking fee since I bought the phone at full price and did not open a new line.

As others have mentioned, I made the move to the Evo due to the carrier, vs the phone (3gs) that I was using. Sprint has much better 3g and now 4g coverage than ATT once you leave the city limits around Kansas City. I do however think HTC did a horrible job at quality control. I'm on number 2, and after the screen lifted up to let light leak out about 75% around the screen and the battery door may as well be a pc of paper you tape on... number two so far only has the crappy battery door that gaps open. Time will tell if the screen decides to leak again.

Battery door aside number two hopefully will stay together. I've worked out the battery issues and have this one setup so it lasts a full day and then some based on my usage. I am disappointed with the camera's performance and the terrible compression the video's display when trying to record but hoping software updates may help with the compression issues, or at least give us a choice to record in full HD vs compressed to hell, wanna be HD.

Imo Apple's hardware is still better quality than HTC's, but the ATT vs Sprint is no contest which will keep me with Sprint. The fact the Evo is the best smartphone Sprint currently offers will likely have me hang on the Evo until a better phones is released.

I would think it'd be 30 days after the exchange date, so 7/25 should be your last day (not 100% sure). How else are you going to get confirmation, without verifying with your store? Even if anybody on here tells you otherwise, it doesn't mean that store will have the same policy. Trust me, just go in and talk to the Mobile manager, just to verify. Be curtious about it and take down their name, the date and time that you speak with the manager and you're all good. If you don't do that, you're going to end up S.O.O.L. trying to make a claim off of information you got from the internet.

Sprint's policies are different than Best Buy's, so it's not really applicable in your case.

The 30 days starts from the date of activation. Not the purchase.

If it starts on day of activation, that would mean 7/24 is his last exchange date then, correct?

Check with your nearest Sams Club/Cosco's to see if their cell phone kiosks have them in. I work at one and talked to our cell phone people and they scored me one a few days later.

Also, I like their return policies. $100 for 2 years worth of insurance, no questions asked.

consign on Sams... I was able to get one from Sams on launch day WITHOUT pre-ordering

Im willing to put up with a few issues for a great phone. With more updates and Froyo comming out? Heck ya.

The processing power is there, the camera is nice, the customizablility.

Ill keep it for a year :) new stuff is comming next year. So why bitch about the phone for 6 months when you are going to replace it in another 6 months? lol

KEEPER

Keep, best phone I've ever own. Battery is a no issue now with the latest update. It's only a matter of time before we get Android 2.2 update and the 30FPS remove. Than this phone's full potential will be unleash.

I lurk here on behalf of my father who "has" an evo(he is awaiting his replacement) to see exactly what is up and any new things i can show him about his phone...

i say you should definitely probably return it and await the samsung epic device coming to sprint...it looks promising and it might..."MIGHT" even be better than the evo.

Now if only the samsung fascinate would come to verizon...SOON :)

and this article i read here seems to portray a lot of unhappy customers
Many HTC Evo 4G Owners Express Dissatisfaction With Sprint Customer Services

I pulled the trigger and returned my worthless brick to Best Buy today. It bricked Monday afternoon with the double update. I have been calling literally EVERY Best Buy and Sprint Store within 45 miles of my house every day. I've also been checking Sprint and Best Buy online. No one has EVOs right now.

FYI... my original EVO was purchased June 4th on launch day. I exchanged it for EVO #2 on June 24th. I was told that even though I exchanged it, that the original purchase/activation date is the date the 30 day clock starts from.

I'm sure that individual stores will work with customers with bricked or defective devices to exchange it for you after the 30 day period, but you darn well better ask to speak to a manager and get it in writing! Don't accept some geek squad's promise. They told me they would honor my exchange for a 3rd EVO after the 30 days.... I just decided I was better off getting my money back so I have more fliexibility to buy it wherever it comes available first. Or if it isn't in stock for months... buy an EPIC 4G!!!
