Help No data connection while on a call

My husband just got an infuse, after he first turned it on and made his first call he also tried to check something online and got a no data connection message. Same thing when he tried to use the market. Since he didn't really do anything on the phone he did a hard reset this seemed to fix the problem or so we thought. It worked for all of 10 minutes then the same thing happened. This happens even if he is on wifi.

Also his phone isn't automatically switching from wifi to the mobile network when he walks away from his wifi source.

Make sure this is checked on...

Go to
Settings.. Wireless and network.. Mobile networks.. Use packet data.. Make sure use packet data is checked on...

Yeah that was the first thing I checked. I just don't understand why he can't surf the web on while on wifi and take a call. He can do it with his inspire no problem. Once he is off his call then wifi works. Also the inspire once out of range from wifi will automatically switch over to the mobile network but not the infuse he has to turn wifi off in order for it to use the mobile network.

Well now the phone is having other issues. When on a call it will randomly hang up (even if using speaker phone so i can know it's not a cheek hang up) then once it hangs up you can't use the phone for at least 15mins any attempted calls out result in a no connection error and calls in go straight to voicemail and the phone is frozen nothing will work.
Did 2 hard resets, reset the router 3 times trying to fix the wifi issue.

Time to take it back I guess...
