So i was using sholes 2.06 and running at 800 mhz would get my phone around 40c which is too warm for my liking

will running a rooted phone at 800 mhz always run warm bb or droidmod 1.0? or can certain mods make it run cooler?

Varies on the ROM, your settings, your use, your signal....

I have seen people complain that certain ROMs run hotter.
Only instance I had of this was when I updated to BB 1.0 from 0.7.8 and that, settings wise, was apples to apples.

Is it possible that certain ROMs or Kernels are upping the voltage and others are not? Could also explain why some are stable at certain speeds.

i am sure its that mixed with other variables. like kernel speed plus live wallpapers? or kernel plus doing something very tasking. hard to say, my phone was running swell at 1000, no over heat, but i ticked it back to 900 just cause its comfortable for me
