Class Action Suit for 2.0

Well, Samsung tech support just got back to my email:

Dear Fordude,
Thank you for your correspondence. We sincerely appreciate your taking the time to contact us with your concerns about the delay and lack of information regarding the operating system update for your Behold II.
It is not our intent to be neither neglectful nor unresponsive to this matter. We would like to assure you that Samsung Mobile is listening to the feedback we are receiving from customers about this, yourself included. We are working diligently to be able to provide more complete information shortly.
We value your time and would not impose further to ask that you contact us for these updates. We will keep your contact information on hand so that we can respond to you directly once we are able to offer additional information.
We also value your continued interest in our products and are truly committed to your satisfaction. Again, allow us to express our thanks for your patience and understanding.

How about we start a fund to buy billboard time by their corporate office letting Samsung know just how upset we are about their promise?

I am neither for nor against legal action...at this point, but if you guys are really serious about a class action one of you needs to step up and become the "Lead Plaintiff" I have gone ahead and included some info on calss actions below:

Class Action Lawsuits:

If you have been injured (does not necessarily mean physically injured) in a way that many other people have been injured, you might want to start a class action lawsuit and become the Lead Plaintiff. Your first step in doing this would be to find the right class action attorney:

  • who is experienced,
  • has a good track record, and
  • has adequate resources to help you launch a successful lawsuit.
Experience: Like other attorneys, class action lawyers should be competent in the area of law relevant to your case. A class action lawyer who handles security cases would probably not be a good choice for a defective products case. You want an attorney who is competent in your kind of case and is also experienced with class action cases.
Track Record: You will want to know the lawyer’s track record with class action cases. What percentage of class actions has the attorney resolved successfully and what kinds of settlements were reached? If a class action attorney recovered millions for him or herself, but little for the class, you may want to find a different attorney. You can ask the attorney to provide information about his or her history, and you might also want to talk to a Lead Plaintiff from a former class action lawsuit to see how that person liked working with the attorney.
Resources: In addition to competence and experience, you will want to make sure that a prospective class action lawyer has the resources to fully research and handle your case. You will want to know if the law firm is financially stable and how many other class action cases the firm is handling. If the firm lacks resources or is overextended, it may not be able to adequately pursue your class action.
You might be able to find a class action attorney through personal or professional referrals, but if that fails, you might research successful class action lawsuits similar to yours and contact the attorneys involved in those cases.



What’s In It For the Lead Plaintiff:

The Lead Plaintiff is the named party (or parties) in a class action lawsuit. The Lead Plaintiff, also called the class representative, representative plaintiff, or named plaintiff, is officially appointed by the court at the time the lawsuit is certified as a class action. He or she must be capable of representing the interests of all the members of the class action. The Lead Plaintiff is responsible for:

  • hiring the class action lawyer,
  • filing the class action lawsuit,
  • consulting on the case, and
  • agreeing to any settlement.
The Lead Plaintiff has the advantage of being able to consult closely with his or her attorneys regarding settlement offers, and is the only party who may object to a settlement agreement. Lead Plaintiffs may also receive more of the settlement or recovery at the end, at the discretion of the court, depending on the extent of their injuries and level of participation in the case.
Lead Plaintiffs and Hiring an Attorney
Though the Lead Plaintiff enters into an agreement with the attorney in a class action, the Lead Plaintiff is not responsible for attorney fees and does not take a monetary risk. Attorneys in class action lawsuits usually take the cases on a contingency fee basis, which means the attorneys pay all costs during the case and recover those expenses and their fees only if they win the case. The Lead Plaintiff is usually covered for expenses such as travel, copying, and postage by the attorneys.
Lead Plaintiffs as Consultants
The Lead Plaintiff participates in the lawsuit directly, which may mean participating in discovery—the process of gathering information that may involve answering written questions, producing documents and other evidence, and having sworn testimony taken in front of a court reporter. The Lead Plaintiff also attends hearings, trials, and other court proceedings.
Lead Plaintiffs and Settlements
Perhaps the most important role of the Lead Plaintiff is to consult with the class action lawyers about any possible settlements. The vast majority of class action lawsuits settle after they have been certified, so settlement discussions are very likely. It is the duty of the Lead Plaintiff to represent the interests of the class and not just his or her own interests. Only the Lead Plaintiff has the ability to object to a settlement agreement. All the other class members can only opt out of the suit if they don’t like the settlement, so the role of the Lead Plaintiff in approving settlements is very important.

Umm... Getting billboard space isn't exactly cheap I imagine it would cost thousands....

they are giving us 1.6 with some bonuses but no 2.x ever.

BTW they did just rip off bh_mans work as if you read their description its exactly what eugene already gave us!!! including swype and update core apps


To be fair to Samsung, eugene's source was from them. That being said, it is no excuse for them. They are just dumping this on us to hush the storm that we've fired up. This phone was promised to have 2.0 and they backed out. We either need their source files for the drivers or for them to STEP UP and actually do it. It appears as though they have made a stand and that stand is to still be shady. I will never support another samsung product again.

i'm talking more about the ideas and some edits...they were lurcking his threads for the past fews days on androidspin and then made this statement...um lets see there big improvements...swype, and better media player...

anyway i'm just pissed cause its not good enough...its not even 1.6 w/ touchwiz 3.0...just the same old crap!
 
Heh oh didnt see it already posted. Anyways, why not now try to push to release the full source if they wont give us 2.x?

Check it, Samsung has just copped out and plan on making the 1.6 rom official(it was just a leak btw).
