Class Action Suit for 2.0

"not upgradeable" So either they were intentionally misleading us (or outright LYING to us). OR the product is defective.
Either way, they owe us.
 
Oh its defective alright. Mine has a big mark between the D-pad and the screen that say SAMSUNG........ that is a huge defect.

Someone should step up to the plate and become lead plaintiff in the class action regarding this matter.

I just recently hit my behold 2 andu switched from a mytouch cause I like the looks and hardware if the behold 2 better. I rooted it first day and have bern living it way more than the mytouch. So im new to all this drama and I think samsung is really doing us wrong and I am also down for a lawsuit. Atleast they could admit it and say they have no smart workers who can get 2.* and just open the source code to the developers so the real smart guys that samsung should be paying like BH_MAN can get us 2.1

Alright...what exactly is stopping you then? I'm noticing a pattern...your legs broken...why don't you "step up" and do it?
 
If anyone else wants to try, after spending an hour and a half or so on the phone with T-Mobile, they offered my the MyTouch Slide for the a full discount even though I just got the Behold 2 in March. I had to talk to Care, PDA, Loyalty, and then Account Services, but they finally offered it to me. I need to start my contract over, but the full discount was about $100 less than the partial discount I was first offered. The only thing I lose is the Mail in Rebate of $50. But hey, $250 is better than $550. Give it a try if anyone wants. They also said I could keep the BH2 and sell it to lessen the cost. Radio Shack will buy it for $70.

Again, EM+ subscribers will be screwed because we don't have contracts to extend.

Lol^ I think it's all pointless. Most got this phone for free or paid around 200 for it, if you didn't then I understand why your upset. What end result will there be? Even if there was a good end result, you will most likely switch the phones before it takes into effect. Just my 2 cents.

Yup, I went through this exact same scenario 2 days ago with them. They noted it on my account so that I can go to the TMO store at MOA next Wednesday when the slide is available.

This is some bad press for Samsung, I think they should hire BH_MAN to develop 2.1 for them! :-)
 
For the folks who have negotiated with TMO, did contract cancellation come up as a possibility? While the MT3GS is nice, I'm not in love with it and it might be nice to keep options open. I would prefer to have a contract cancellation and then could either resign with TMO for a MT3GS or look elsewhere at other options.

This was another option presented to me when I talked with Loyalty dept. However, the caveat was that I loose my current number and have to re-apply to get it back. Which they said could take 1 - 2 weeks.

I got some little bit of information out of Tmoble's Executive Customer Support. The way they describe it is, well yea its all Samsung's fault. The G1/myTouch/Cliq were designed as what they call PDA first while the Behold II was designed phone first(Think difference between smartphone and featurephone). So yea it might be some BS, but thats what I was told, since due to it being built up this way, it really can't support 2.x hardware wise(think cpu being clocked down, etc).

But in exchange for being such a loyal Tmo customer and well my excellent letter writing skills, I've been given an awesome offer that brings back my faith in Tmo to do right by me. Not saying if everyone does the same you'll get the same deal I got but basically treat the helping hand right and you can get some nice rewards.

I appreciate that. Thanks for the information. Seems like a silly demand for them to make though for something that is essentially a billing entry in a database. Personally the fact that I have the number and it's known to many locations (not the least of which are doctors, utilities, family, etc) is an incentive to stick with a carrier. I know there's number portability but if they're really looking to retain my patronage, that's not an advantage I'd want to surrender as a seller. But I suppose that's their call.

Im doing the same. My contract is good for cancellation tomorrow, so I called to make sure and told them I might switch to Sprint, and he told me he could guarantee some type of discount if I don't leave. So Im going to call Wednesday and see what I can get on the mt3gs, and if it's nothing good then I will just cancel (But i think he would give me some type of discount since they are scared to lose customers)

I got decently angry. Started off nice until I got to PDA and I had someone who wanted to research why my phone wasn't getting the minor OTA updates (which she didn't understand I don't give a crap about) so I had her to switch me to Loyalty. Spoke nicely to Loyalty who told me they can't handle those type of exchanges so they transferred me to Account Services. Again started nice but she was trying to give me a partial discount and once I raised my voice some and asked to speak to her supervisor, the supervisor offered me the full discount.

As far as cancellation, it did not. However I am not the main line on my family plan so I didn't go there seeing as it wasn't up to me. Good luck.

I was honest with them and said I was happy with their service and customer care, just very disappointed with the phone. I also told them that I use this phone to conduct daily business and I can't rely on it as it is not dependable and crashes continually. That along with the fact that I purchased this in Feb and was on my 3rd phone made the decision much easier for them IMO. I never raised my voice, I just voiced my frustrations. I have been with TMO since 1997 when they were VoiceStream. They have great coverage in the Twin Cities/Minneapolis area and have been the most reliable carrier for me.
 
So what about us EM+ customers? I really want out of this phone, but I don't know how to go about it. I'm a member on my family's EM+ plan--what are my options? Is my only option to sell this phone, pay the remainder of the owed amount to TMO, and then buy a new phone? Is there anyway to get a trade-in?

Any advice is much appreciated.
 
As a policy tmobile does no trade ins. Some retailers do though if you want to know your options you need to get in touch with tmo as none if us here can answer that question only tmo can
 
So what now? Samsung is reluctant to update to 2.x, they obviously prefer to sell more phones than support what they already sold. It's amazing this business. They sell a product that is basically a computer, and costs as much as a PC (without subsidy), and they don't think the software should be upgradable. Would anyone buy a PC from them if they knew they could not upgrade the software?
Did anyone hear from the BBB? Did anyone contact any lawyer? There are over 600 signatures already on the petition.
