Class Action Suit for 2.0

So what about us EM+ customers? I really want out of this phone, but I don't know how to go about it. I'm a member on my family's EM+ plan--what are my options? Is my only option to sell this phone, pay the remainder of the owed amount to TMO, and then buy a new phone? Is there anyway to get a trade-in?

Any advice is much appreciated.

Walmart will give you $90+ bucks for it.

EDIT: Ok I just did it. They send the box and I send it off then they send me $126 on a prepaid debit card which I will use to buy the MT3GS.
 
Oh joy, I had to fight with 4 different computers to get his installed. Go figure they release the actual. Would I have to revert to 1.5 before I upgrade or is it fine to upgrade from the rom?

The update will also supply additional benefits including Swype, an improved Media Player, updated core Android applications and improved Bluetooth capabilities. However, the Behold II is not upgradeable beyond Android 1.6."

Rectify misstatements? Also to meet or exceed my expectations would be to provide a phone that has a current operating system so I can download current applications. I wonder if they were to put themselves in our shoes as a consumer if they would be happy with staying at 1.6?

This has been said here before but I too really wonder how many of these phone manufacturers are going to continue to provide upgrades to Android phones when it could possibly cut into future sales of newer phones?
 
Alright...what exactly is stopping you then? I'm noticing a pattern...your legs broken...why don't you "step up" and do it?

Because while I've had time to find the videos in the first place, send out info to some of the bloggers, and try to stay on top of this for the past few days, I do not have the time to set myself up as the Lead Plaintiff in a case. The Lead Plaintiff has to have enough time to devote to the case to be able to speak on everyone's behalf.

So....now that you have my response...what's your excuse ?

i agree.. i would fully love to step up to it myself.. HOWEVER... ive got alot bigger fish to fry in my life... i simply dont have the time to devote toward being the lead plantiff.. not only that but i feel like they wouldnt take a 25 year old serious
 
Hey Fresh, have you noticed any better behavior with regards to signal and data transfer rate quality since updating the phone part ?

Well when I went back to factory I would say it was about the same as on BH_Man's Custom Rom. I think BH_Man's Custom Roms are slightly faster though in regards to data transfer and signal.
 
My excuse is I don't want to sue...I already said that! There is no case! You talk about all you've done but huh...this is the first I've heard of you.

On the other issue, if you don't want to sue....fine...don't join in. And if you're an attorney, then maybe you have a point ( and maybe you don't ). But if you're not an attorney, then if other do want to try to pursue is no skin off your nose.

I posted the following in the description of the problem:
In November 2009 Samsung and Tmobile launched the Behold 2 Android based smart phone. At the time of the launch, the Behold 2 was using Android version 1.5, all of the Tmobile sales reps, numerous marketing materials and several webcasts declared that Samsung would be updating the OS of the Behold 2 to Android 2.x (which was released by Google several weeks prior to the Behold 2 product launch). Many people (including myself) bought the phone with the understanding that the OS would be updated to at least version 2.x. Last week Samsung announced that they would not be offering that update. I believe that Samsung acted in a self-serving and misleading fashion about their intentions. I wish to get either a refund of the my cost for the phone along with a buyout of the 2-year contract I had to enter to get the phone or a replacement device of my choice which utilizes the current android operating system (2.0, 2.1 or 2.2 - depending on device). Hey guys, i just found this site a few days ago. i bought a behold 2 back in january, it is my 1st smartphone and i have to say i'm a bit disappointed w/ the phone not getting a 2.x OS update. in addition that, the phone randomly reboots, and it also starts randomly vibrating. when this happens none of the buttons respond and the screen stays blank, the only way to stop it from vibrating is the pull the battery...and wait 3-4 minutes for it to boot back up.

may i suggest that you submit your story to consumerist.com? that site has an excellent track record for getting companies to respond to consumer complaints.

i've had the phone less than 6 months, and it's only been out less than 1 year and it's already at end of life. the issues stated above are very annoying but that along w/ the fact that the only update Samsung is supplying for the phone is from 1 seriously outdated OS to a slightly less outdated OS put me over the line, i've purchased a new phone and it should arrive on wednesday. i have signed your petition in the (highly unlikely) hopes of being reimbursed my original purchase price from the behold 2 to use towards the price of my replacement phone.

anyway, good luck, hope you guys get something(refund, proper update, or replacement phone) from Samsung for the crappy way they have handled this phone.
