Class Action Suit for 2.0

I always see this as a reason for not using Galaxy. Do you honestly get up in the middle of a meeting to answer your phone? If I'm ever in a meeting, my phone is hidden and checked after the meeting.

Vibrate is really not that useful. Especially when the final Galaxy build has incredible battery life and is wicked fast.

I would hardly call 8 hours incredible:( but fast yes.

Interesting. My battery life was horrible at first, but with GPS and WiFi off when not in use, my battery is lasting a really long time now. It took a couple of days for this to happen, but my battery is lasting incredibly long for a smart phone now.

i prefer it at home when my room mates are around.. i do alot of txting and a constant notification is quite annoying to other parties when you are trying to watch tv
 
other then that.. i think your right.. vib is over rated.. lots of people say meetings.. but like you.. i wouldnt answer or even look at my phone during a meeting.. so i only use vib when it bugs other people.. such as my earlier post :P
 
According to a lawyer I know, here is some insight to help anyone still pursuing this and sorry if this has already been said...
but since the product is not defective (sorry the Samsung logo is not a defect) it is going to be really hard to win a suit. In order for a suit to have affect people need to prove that they were depending on the 2.0 update and that is why they got the phone, Samsung's tv advertising did not advertise that 2.0 was going to be available. In order to prove that the this phone was purchased because of the update you will need to have viewed the web video stating that it will have 2.0 first and then purchased the phone, that would be the best way.

Umm people were also told by tmo reps that it would get an update. It was a selling point for some so the web video is not even needed necessarily. And uh yeah i would consider a factory behold 2 defective. It still has the remounting issue and horrible battery life and all the original problems that it had before the maintenance update. It did not solve a thing.
 
I agree. 2.0 promise is what sold me... But, I've been using Factory to get my Replacement & man I forgot how bad this phone sucked..

To me it feels like trying to run with your shoe laces tied together with your shoes 2 sizes to small and on the wrong feet.
 
I spoke with my brother over the weekend, who is an attorney, regarding this Samsung fiasco.

He basically said that anyone who bought a Behold II would have to prove they were damaged by not receiving the 2.x update. Then whoever is handling the case would probably have to bring in expert testimony ($$) to quantify the amount of damages and to prove that 2.x is, in fact, installable on the phone.

The fact that everyone is jumping ship and the will to sue Samsung is losing steam...

Seems that most people are considering:

1. either selling their phones
or
2. getting some kind of upgrade from T-Mobile

it would be damn near impossible to prove any type of damages if you followed either of the 2 routes above.

Unless there is a big demand for a class action lawsuit, and the community is able to find a way to fund it, it probably wont happen...

What might happen is we can pelt Samsung with hundreds (thousands?) of small claim suits. They are easy to file, require a lower standard of proof, and easier to win.
 
Sounds like we would have to sue over False Advertising.. Other than that, ? idk..
Yeah, to me it's not even worth it anymore.. Just want out of this bad dream I'm in starring the Behold 2..
 
....I originally bought the BH2 because I saw the reviews, but THEN saw the video from Samsung saying 2.0 would be released for it. My mistake was in not wanting to create a new contract ( I've been contract-less with them for almost 9 years....with them almost 11 years now...it was called Omnipoint back then ) I picked one up through Craigslist from someone nearby, who wanted to go back to Blackberry. Suits me right for not having splurged on the N1.

Now, I just want out of this "having to have 2 chargers, one for home, one for office" because the #$@% battery won't last for more than 6 hours at a time. Yes, some of us have to use data services ( I've had wireless internet of some sort or another since 2003/2004 ), and actually require the thing to last for a full workday.

I think part of why it runs down is the silly coverage in my area where I'm right at the edge of 3 towers, and never quite lock on any single one for a very long time, so the #$@% phone spends most of it's time cycling through looking for signal.

Anyone venture a guess if I have a shot at pulling something out of the hat here ? Just curious ( though I can imagine what some folks' opinions will be ).

At least I tried to get some attention thrown on the problem, hoping Samsung would "do the right thing".

well i think everyone is on the same page.. and are just tired of this bs... now i tried talking to a rep today so i could get my phone sent back as defective.. because now my phone locks up every time i end a call.. i have to pull the battery.. which is completly effin stupid! NOW guess what the rep said.."well looks like your due for an upgrade to 2.0"... thats where i corrected her.. so it looks as if there is either some miscommunication between samnsung and tmobile.. or tmobile is now lying to us...im unsure

Another guy stated that a phone tmo rep we may see 2.1 update. for now I will say coincidence but if a 3rd comes on here and brings new info it could be possible that samsung is going to correct their mistake. They can't legally intentionally lie to us that is beyond wrong.

It would not be Samsung changing there own mind.

Go look at the four major cell phone companies and you will see that T-mobile carries the most samjunk out. They piss off Tmo's customers they piss off Tmo.

If Tmo said "if your going to do our customer base like this pack your shit and go" samsung would slap 2.2 on this phone so fast it would make your head spin.

If only that would be the case but thats just day dreaming most likely. It would be a good thing for tmo if they did because a carrier that backs their product is a carrier worth switching to or staying with. Who knows with this new CEO running tmo it could be possible but he won't take effect till july i think.

That's probably why they gave you the even trade. I doubt those of us who made the contract purchase would have such luck.

Frankly I'm quite happy with Take5 on the Behold 2, but then I get frustrated that I realize that I'm stuck with this phone for another year and a half. I foolishly hoped when getting an Android phone that it was going to be like a PC where I could upgrade the OS when I wanted too, but clearly not so much.

Well now I know better.

I'd place money on that rep being mistaken. While there are some reps who do keep their eye on what's going on, I think many of the reps only know what's on their computer screen.

Well this confirms one thing at least... we will have an OS update this month.

It might be 2.1 but if anything else has come from this its that this will help us in our lawsuit if we do not see 2.x

Tmobile themselves stated that market is inoperable on 1.5 and 1.6 that we would NEED 2.x! to resolve this issue.

The rep seems to feel 100% certain on all information previously given.
